The Right to Information on the Environment in the Context of Freedom of Information

The thesis describes an issue of the constitutionally guaranteed right to information on the environment. The aim is to provide an overview of an effective international and especially national legislation, compare both fundamental acts on information and highlight the insufficiency of the Czech regulation. Apart from the introduction and conclusion thesis contains four chapters. Preliminary presentation of fundamentals and principles of the legislation is followed by summary of sources of law. Attention is given to Aarhus Convention and two acts on information. Following chapters deal with the effective legislation and determine differences in the providing general information and environmental information. An overview of selected judicial decisions is included before final chapter. Particular attention is paid to the obligations arising under the Aarhus Convention and its implementation into legislation. Mentioned are main drawbacks of the regulation and related difficulties in application of law; possible legislation de lege ferenda is outlined as well.
Protection of Cetaceans in International Law

In four chapters that this thesis consists of is presented the protection provided to cetaceans by international law. The first chapter gives insight into the biology of cetaceans, names facts relevant to their conservation and its legal basis. The second chapter deals with legal regulation of whaling. It analyzes the history and current situation in the International Whaling Commission as the only global organization to manage the exploitation of large cetaceans, particularly in terms of adopting protective measures for the recovery and conservation of whale stocks. The third chapter focuses on the species approach in protection of cetaceans as endangered animals. The fourth chapter addresses the protection of cetaceans' environment. First it deals with the protection of marine environment in general and then with the protection of cetacean habitats.
Legal aspects of gold mining and its influence on the environment

The aim of the diploma thesis is the description and analysis of legal aspects of gold mining. The thesis is divided into 7 chapters including the introduction and the conclusion. The second chapter provides the elementary overview of the characteristics of gold, its extraction and gold ore processing methods. The third chapter deals with the sources of legal regulation of mining and reminds the historical development of this legal branch. The fourth chapter is in detail concerned with individual phases of the reserved minerals mining. The fifth chapter introduces the main impacts of gold mining and mineral raw material extraction respectively on the environment and people. The sixth chapter analyzes basic legal instruments of environmental protection exercised in mining, focuses on their application and deals with their suitability. The conclusion of this thesis is focused on evaluation of topics discussed in previous chapters, primarily summarizes particular aspects of gold mining and problematics of legal regulation of mining and environmental protection used in this field. Recording rights and other data in the Land Register (Cadastre)

This diploma thesis deals with the recording rights and other data in the Land Register. This thesis looks at the history and the principles of the Cadastre. Every way of entering in the Land Register is analyzed in the thesis, the text points out changes made due to re-codification of private law. The attention is paid to the entry of legal relations and recording procedure.
Legal regulation of the environmental impact assessment

Environmental Impact Assessment is one of internationally recognised tools providing environmental protection. Purpose of the assessment is to identify and comprehensively evaluate environmental impact of a project with participation of the public, professionals and administrative bodies, prior to the realisation of the project. Information gained through this process is then used as a basis for decision making in procedures granting development or other consents. The thesis aims to analyse in particular the Czech environmental impact assessment law with emphasis on its recent amendment and reasons of its implementation.
Legal regime of water related land

The introduced graduation theses deals with the issue of legal regime of land associated with water. In the four major fields, which are water courses, land relations in area protection of water, land relations in areas endangered with high flood and land relations connected to waterworks, the theses analyses legal regulations of land relations with the emphasis on limitations of ownership, which conclude from these relations. In the center of attention of the theses are the laws in the water act, laws which are inferior to the legal force of the water act and laws in the new civil code.
The Ownership Right to Land

The thesis deals with issues relating to the ownership of land, analysing it on two different levels. On the first level, it defines the ownership of the land, particularly its object and subject, and also describes the specific properties of soil, and their manifestations in land property rights and related legislation. On the second level, the work discusses selected institutes in terms of problematic issues that have arisen in connection with the introduction of the Act no. 89/2012 Coll., Civil Code, which has brought into our legal system new institutes or modified to some extent the old ones. The thesis compares the current and the previous legislation and with the aid of the specialized literature seeks to answer the question whether it is possible to perceive these changes positively or whether they are considered rather negative and problematic.
Rights to use the land

This diploma thesis deals with issues relating to land-use rights. The most frequently used institutes of these rights are lease and tenure, which therefore logically constitute the main points of this work. Subsequently other forms of use rights, such as precarium, loan, personal easements and also the right to manage state property and regional self-governing units, are briefly addressed. This work is based on effective legal regulation and also strives for a comparison with preceding legislation, mainly with regards to recodification of private law. Within the chapter on the right to manage state property, this work also familiarizes the reader with public-law regulations.
Landfilling legislation

Abstract AJ The goal of this thesis is to thoroughly chart the problem of waste management in Czech Republic and the European Union and to outline legal and economic situation in waste treatment and in its alternatives. This thesis deals with different types of landfills, their technical aspects and methods of depositing waste. The thesis also tries to point out material and energetic use of waste before landfilling. Recycling is considered to be important because it decreases the amount of waste stored in landfills. Composting and anaerobic digestion are the other methods of disposal. The thesis also describes the possibilities of usage of the landfill gasses with the help of cogeneration units. The thesis refers to current level of waste landfilling in the Czech Republic and in other countries of the European Union. Selected issues of legal regulation of the environmental impact assessment

The subject of this dissertation are selected issues of legal regulation of the environmental impact assessment. The dissertation aims to assess the legislation from the viewpoint of efficiency of an environmental protection against the negative impacts of projects on the environment and public health. The dissertation is divided into four chapters further divided into subchapters. The first two chapters are focused on a development of an EIA institute since its start, as well as international, European subsequently Czech incorporation into legislation. The third chapter examines the term of subsequent procedure as a fundamental condition for defining the set of rights and obligations in the proceedings in which projects should be allowed. The last chapter is a comprehensive overview of the various forms of public participation and opportunities for the public to enforce their interests in the assessment of the effects of projects on the environment.
