Criminal liability in environmental protection

The name and the central topic of this thesis is "Criminal Liability in Environmental Protection" and it is divided into two main parts. Firstly, it is an analysis and a description of a valid legal regulatory framework of criminal liability in environmental matters within the Czech legal system with a full description of each of the offences against environment under the new Criminal Code, Act N. 40/2009 Coll., as amended. The focus of the second part is on the international illegal trade in wildlife and the problems of enforcement. First chapter of this part is dedicated to the Convention on International Trade in Endangered Species of Wild Fauna and Flora. In the second chapter I focus primarily on the problems of enforcement, which remain even though wildlife crime (and environmental crime in general) seems to benefit from an increasing profile amongst agencies tasked with its control. The last chapter of this part aims to explain the term "Situational Crime Prevention".
Legal Regulation of the Natura 2000 Network in the Czech Republic and the Federal Republic of Germany

The network Natura 2000 represents a system of nature protection areas, which were established to protect and conserve European biodiversity of wild fauna and flora. This master thesis copes with the legal aspects of implementing European directives in relation with the Natura 2000 network into the national legal systems. A comparison was made between two EU-member states, the Czech Republic and the Federal Republic of Germany. The master thesis is divided into 7 chapters including the introduction and the conclusion. In the chapter 1, the subject and aims of the thesis are explained, as well as the brief history of nature conservation. Development of nature conservation in International and European law is introduced in the chapter 2. The chapter 3 focuses on legal basis of Natura 2000 regulations on European law level. Essential parts of the master thesis are the chapters 4, 5 and 6, which describe how the network was established through site designation, how the protection and site management is ensured and what assessment of plans and projects means. The law system of Saxony was chosen as an example to display some partial distinctions between the federal law level and the federal state law level in Germany. The legal regime of practicing tourism and sports in specially protected areas

The diploma thesis deals with legal regime of practicing tourism and sports in specially protected areas of the Czech Republic. Specially protected areas are areas with stricter protection regime of nature on specific accurately assessed flat territory. The thesis is composed of five chapters dealing with mutual relationship between sports and environmental protection, general definition of law of specially protected areas of the Czech Republic with a focus on protection tools and sports and tourism activities. Last two chapters are devoted to the pursuit of climbing in the Protected Landscape Area Jizerské hory and the National Park České Švýcarsko. The subject of the thesis is right to information on the environment in the context of the free access to information. It is a progressive area of international law and czech law as well. Their common aim is to guarantee right to information to everybody without exceptions and to remove effectively the obstacles in access to the information. Environmental information are useful instrument for establishment and strengthening of civil society. This thesis aims at anaylising the content, importance and position of all the principal sources of law and determines relationship between them. The thesis puts emphasis on the analysis of the czech law and on finding its possible deficiency.

SUMMARY Delictual liability of natural persons in protection of the environment The purpose of my thesis is to analyse actual legal regulations of delictual liability of natural persons in protection of the environment. Delictual liability in protection of the environment includes a criminal liability and an administrative liability. The liability is one of legal instruments which the state uses for the protection of the environment and means that person who committed a breach of an obligation is obliged to endure appropriate consequences. The reason for my research is the fact that people quite frequently breach their duties, thus consequently endanger or harm the environment. I wanted to know more about the legal regulation concerning this theme. The thesis is composed of seven chapters, each of them dealing with different aspects of delictual liability of natural persons in protection of the environment. Chapter One is introductory and defines basic terminology used in the thesis. Chapter Two addresses the issue of legal liability in general. Chapter Tree investigates delictual liability in general and delictual liability of natural persons in protection of the environment. Resumé The aim of the thesis is to provide a comprehensive overview of the current legislation of viticulture and winemaking in the Czech Republic, its historical evolution and it tries to approach the changes that shall be introduced by upcoming amendment of Act. No. 321/2004 Coll., on viticulture and winemaking and on changes of related laws. The work is divided to five chapters which are for clarity and better understanding of the issue divided to subchapters. The first part deals with the historical development of legislation of viticulture and winemaking in the context of evolution of the society and historical events that affected the development of viticulture and winemaking activities. The second part deals with the position of viticulture and winemaking law in the legal system of the Czech Republic and its connections with other branches of law. The third part provides complex overview of current Czech legislation of individual institutes of viticulture and winemaking law in relation to the provisions of the European law. Delictual liability of natural persons in the environmental protection I have chosen the subject delictual liability of natural persons in environmental protection for topic of my Master's degree thesis. The first reason why I have opted for this subject is due to the fact the environment is present everywhere and is a resource that needs to be protected as it is necessary to the human kind to survive. The law is one of the most powerful tools that can help protecting the environment. The second reason is that it does allow me to link several other law areas of interest which are administrative, criminal and environmental. The thesis contains three main parts. The first one is mainly dedicated to the legal liability while focusing on the responsibility in the environmental law. Also are mentioned the fundamental principles of the delictual liability in the Constitution. The second part relate to the criminal liability of natural persons in the environmental protection, starting from the basics of the international and European Union law. Territorial environment protection and the NATURA 2000 Network

The thesis is focused on the theme, which is current almost every time, even in every state, and that is the protection of the nature. We all are a part of the nature, which is all around us. It must be protected, so as future generations can experience its beauty. The interest in the theme results from the author's job that is why the author decided to discuss the theme and outline its difficulties. The work itself is divided into three parts. Most of the first part focuses on the specific territorial nature and landscape protection, which consist in announcing various categories of specially protected areas; it also focuses on the providing tools for their protection and care. In the thesis, general territorial nature and landscape protection are not omitted, because they, using certain institutes, provide significant protection to the fragments of nature or territories, which do not attain such values to be declared as protected. In the second part of the thesis, the author discusses the type of territorial protection, which is relatively new in the Czech Republic and which was created in connection with accession to the EU.
