[cze][eng] Práce se zabývá aktuálními podmínkami a vývojem oblasti regulace pojišťovnictví na českém pojistném trhu. Zpočátku se věnuje otázce samotné potřeby a podstaty regulace. Následně analyzuje pojistnou smlouvu a práva a povinnosti z ní vyplývající. Mezi nejobsáhlejší část patří úprava podmínek provozování pojišťovací činnosti. Do této části spadají nejen pojišťovny a zajišťovny, ale také činnost pojišťovacích zprostředkovatelů a samostatných likvidátorů pojistných událostí podle samostatného zákona o této problematice z roku 2004. Poté následuje otázka dohledu nad pojišťovnami, jeho vývoj a činnosti, prováděné dohledovým orgánem, který byl v nedávné době změněn. Zahrnuta je i spolupráce s EU včetně ukázání záměrů EU v pojišťovnictví pro blízkou budoucnost. Závěrem je na základě předešlého popisu provedeno zhodnocení vývoje regulace pojistného trhu a odhad budoucího vývoje v následujících letech, při kterém je vycházeno především z dominantního postavení evropské legislativy v této oblasti během posledních let.The work deals with the current conditions and developments in the field of insurance regulation in the Czech insurance market. Initially, the issue itself needs and merits of regulation. Then analyze the insurance contract and the rights and obligations arising therefrom. Among the most part are the conditions change the conduct of assurance business. Within this section are not only insurance and reinsurance, but also the activities of insurance intermediaries and independent liquidators claims under a separate law on this issue in 2004. Then followed the issue of supervision of insurance companies, and its development activities, carried out supervision body, which was recently amended. Is also included cooperation with the EU, including EU projects show the insurance industry for the near future. Finally, on the basis of the preceding description of an evaluation carried out development of the regulation of the insurance market and future prospects in the coming years, which is going primarily from dominance of European legislation in this area in recent years.
