Bakalářská práce se zabývá problematikou nelegálních obchodů na českém kapitálovém trhu. První kapitola se zaměřuje na historii praní špinavých peněz, obecné rysy a jednotlivé fáze procesu praní, dále na konkrétní odhalené případy a Finančně analytický útvar Ministerstva financí. Zvláštní důraz je kladen na 40+9 doporučení mezinárodní organizace FATF. Druhá kapitola se věnuje insider tradingu, neboli zneužívání vnitřních informací, informační asymetrii, Směrnici Evropského parlamentu a Rady 2003/6/ES a příkladům zneužítí těchto informací. Závěrečná část analyzuje současný stav zákona č. 253/2008 Sb., popisuje Mezinárodní úmluvy proti legalizaci výnosů z trestné činnosti a financování terorismu a okrajově nastiňuje právní úpravu insider tradingu. This thesis deals with the issue of illegal transactions in the Czech capital market. First chapter focuses on the history of money laundering, general features and different phases of the laundering process, concrete exposed cases and Financial Analytical Unit of Ministry of Finance. Particular emphasis is placed on the 40+9 recommendations of the international organization FATF. The second chapter is devoted to insider trading, i.e. abusing of internal information, information asymmetry, Directive of the European Parliament and of the Council 2003/6/EC and examples of misuse of such information. The final section analyzes the current status of Act No. 253/2008 Coll., describes the passing of the International Convention against money laundering and terrorist financing and marginally outlines the legislation of insider trading.
