Tato rigorózní práce se zaměřuje na problematiku právní úpravy ochrany oznamovatelů (tzv. whistleblowing) v podmínkách českého právního řádu. Autor se na toto téma zaměřil především z toho důvodu, že širší česká veřejnost doposud nemá vytvořenou základní představu o této právní úpravě a vnímá ji spíše negativně. Mnohdy však důsledkem jejího nesprávného pochopení. Směrnice o ochraně osob, které oznamují porušení práva Unie utvořila základní legislativní rámec, který se stal vodítkem pro členské státy, aby přijali vlastní vnitrostátní úpravu. Na základě podmínek Směrnice byl v České republice přijat zákon č. 171/2023 Sb., o ochraně oznamovatelů. Autor považuje za podstatné rozšířit povědomí o právní úpravě ochrany oznamovatelů jakožto užitečném nástroji, který slouží k ochraně veřejného zájmu a zejména pak ochraně před korupčním jednáním. Důsledkem širší neobeznámenosti veřejnosti s touto právní úpravou v komparaci s nově vzniklým právním předpisem považuje autor ochranu oznamovatelů za vysoce aktuální téma, kdy osvěta je zcela namístě. Tato práce je rozčleněna do dvou základních částí. První z nich se věnuje unijnímu rámci. Popisuje základní koncept celé úpravy dle Směrnice včetně popisu základních nástrojů a pojmů. This rigorous thesis focuses on the legal regulation of the protection of whistleblowers in the conditions of the Czech legal system. The author focused on this topic primarily for the reason, that the wider Czech society still does not have a basic idea of this legal regulation. Therefore, the public perceives it rather negatively. Often, however, because of its incorrect understanding. The Directive on the protection of persons who report violations of Union law formed the basic legislative framework which became a guide for Member States to adopt their own national regulation. Based on the terms of the Directive, Act No. 171/2023 Coll., on the protection of whistleblowers, was adopted in the Czech Republic. The author considers it essential to spread awareness about the legal regulation of the protection of whistleblowers as a useful tool that serves to protect the public interest especially against corrupt practices. As a result of the general lack of familiarity of the public with this legal regulation in comparison with the newly created legal regulation, the author considers the protection of whistleblowers to be a highly current topic, where education is completely appropriate.
