Tématem diplomové práce jsou konsensuální způsoby vyřízení trestních věcí. V úvodu jsou rozebrány základní modely trestního soudnictví, a to adversární řízení pocházející z angloamerické právní kultury a inkviziční řízení původem z kontinentálního právního systému. Text se zaobírá jejich historickým vývojem, základními charakteristikami a odlišujícími znaky. Podstatou kapitoly je vliv prolínání prvků těchto systémů na základní zásady kontinentálního trestního řízení s důrazem na nedávnou novelu trestního řádu č. 333/2020 Sb. Druhá část této práce se věnuje dohodě o vině a trestu, prohlášení viny, nesporným skutečnostem a okrajově i trestnímu příkazu. Jedná se o konsensuální způsoby vyřízení trestních věcí, jež se nedají řadit do podmnožiny odklonů. To je dáno zejména jejich odsuzující meritorní povahou a účelem, kterým je především snaha o racionalizaci trestní justice, tedy její zrychlení a zefektivnění. Třetí část se věnuje odklonům v užším smyslu neboli tradičním odklonům, což je podmíněné zastavení trestního stíhání, podmíněné odložení návrhu na potrestání, schválení narovnání a odstoupení od trestního stíhání mladistvého. Odklony jsou projevem tzv. restorativní justice, jejíž hlavní funkcí je obnova narušených mezilidských vztahů, uspokojení nároku poškozeného a náprava pachatele. Jednotlivé... The topic of this thesis is consensual ways of processing criminal cases. In the introduction, the basic models of criminal justice are analyzed, specifically adversarial procedure coming from the Anglo-American legal culture and inquisitorial procedure by origin from the continental legal system. The text deals with their historical development, basic characteristics and distinguishing features. The essence of the chapter is the influence of the interweaving of elements of these systems on the basic principles of continental criminal procedure with an accent on the recent amendment of the Criminal Code No. 333/2020 Coll. The second part of the thesis is devoted to the agreement on guilt and punishment, guilty plea, undisputed facts and marginally also the criminal warrant. These are consensual ways of processing criminal cases that cannot be classified as a subset of diversions. This is mainly due to their condemning meritorious essence and purpose, which is primarily an effort to rationalize criminal justice, i.e. to speed it up and make it more efficient.
