MEZINÁRODNĚPRÁVNÍ ASPEKTY NÁSILÍ NA ŽENÁCH Petra Presserová Abstrakt Disertační práce se zabývá násilím na ženách z pohledu mezinárodního práva lidských práv. Zkoumá, jak toto mezinárodněprávní odvětví zajišťuje potírání tohoto násilí. Proto nejprve mapuje teoretické přístupy k tomu, jak lze k této ochraně přistupovat. Na to navazuje analýza standardů a garancí, jež poskytují relevantní instrumenty a mechanismy na univerzální i regionální úrovni. Mapuje jak ochranu obecnou a dovozovanou z existujících nepřímých norem, tak tu specifickou, garantovanou přímými regionálními úmluvami proti násilí na ženách. Právě těmto úmluvám práce věnuje zvláštní prostor a vzájemně porovnává Istanbulskou úmluvu vzniklou na půdě Rady Evropy a meziamerickou Úmluvu Belém do Pará. Následně se soustředí na evropský prostor a to, jaký reálný vliv na něj mohla a dále může mít Istanbulská úmluva. Analyzuje tedy, jak tato úmluva ovlivnila dění na úrovni Evropské unie, především návrh směrnice EU proti násilí na ženách, a jak s ní ve své rozhodovací činnosti zachází Evropský soud pro lidská práva (ESLP). Nakonec přibližuje lidskoprávní kontext v České republice a zamýšlí se nad tím, jaký přínos by mohla ratifikace Istanbulské úmluvy přinést ve vztahu ke konkrétním nedostatkům české praxe. INTERNATIONAL LEGAL ASPECTS OF VIOLENCE AGAINST WOMEN Petra Presserová Abstract The dissertation thesis focuses on violence against women from the perspective of international human rights law. It examines how this branch of international law ensures the combating of such violence. It first maps theoretical approaches to how this protection can be granted. This is followed by an analysis of standards and guarantees provided by relevant instruments and mechanisms at both universal and regional levels. It maps general protection derived from existing indirect norms, as well as the specific protection guaranteed by direct regional conventions against violence against women. Special attention is placed on these conventions and compares the Council of Europe Istanbul Convention with the Inter-American Convention Belém do Pará. Subsequently, it focuses on the European context and the practical impact the Istanbul Convention has had and can continue to have on it. It analyses how this convention has influenced developments at the European Union level, especially the directive proposal against violence against women, and how the European Court of Human Rights (ECtHR) deals with it in its decision-making.
