Náhrada újmy v trestním řízení Abstrakt Tato rigorózní práce se věnuje tématu náhrady újmy v trestním řízení a uplatňování nároků na náhradu újmy poškozených v trestním řízení. Cílem této rigorózní práce je pokusit se izolovat nejdůležitější cíle současné právní úpravy trestního řádu ve vztahu k uplatňování nároků na náhradu újmy v trestním řízení poškozenými, přinést v nezbytném rozsahu vhled do problematiky adhezního řízení, která s tématem této práce úzce souvisí, a odpovědět tak na základní výzkumnou otázku: Bylo v současné právní úpravě trestního řádu dosaženo cílů, které si vytyčil zákonodárce ve vztahu k náhradě újmy v trestním řízení? Průběžná hodnocení současné právní úpravy trestního řádu jsou také doplněna o úvahy de lege ferenda vztahující se k možné nápravě či zlepšení současné právní úpravy trestního řádu. Tato rigorózní práce byla vypracována za užití metody kritické analýzy, metody systematické a metody komparační. V první kapitole této rigorózní práce se zaměřuji na přiblížení občanskoprávního pojmu "újma", a to jak ve významu újmy majetkové, tak i ve významu újmy nemajetková. Pro vyčerpání tématu této rigorózní práce se jedná o kapitolu nezbytnou. Ve druhé kapitole této rigorózní práce - podobně jako v kapitole první - se věnuji vymezení pojmů, které přímo souvisejí s náhradou újmy v... Compensation of damages in criminal proceedings Abstract This rigorous thesis is devoted to the topic of compensation of damages in criminal proceedings and the application of claims for compensation of damages of the injured in criminal proceedings. The aim of this rigorous thesis is to try to isolate the most important objectives of the current legislation of the Criminal Procedure Code in relation to the application of claims for compensation of damages in criminal proceedings by the injured, to provide the necessary insight into the issue of adhesion proceedings, which is closely related to the topic of this thesis, and to answer the basic research question: Has the current legislation of the Criminal Procedure Code achieved the goals set by the legislator in relation to the compensation of damages in criminal proceedings? The ongoing evaluations of the current legislation of the Criminal Procedure Code are also supplemented by de lege ferenda considerations relating to possible remedies or improvements to the current legislation of the Criminal Procedure Code. This rigorous thesis has been prepared using the critical analysis method, the systematic method and the comparative method.
