Ústav Abstrakt Diplomová práce za zabývá občanskoprávní úpravou ústavu, jako svébytné právnické osoby. V kontextu dané problematiky diplomová práce také analyzuje míru, jakou se zákonodárci podařilo v relativně skromné úpravě vyjádřit ústav jako samostatný typ právnické osoby. V dalším diplomová práce analyzuje jednotlivá ustanovení a výkladové problémy, které vyčlenění ústavu přineslo. Diplomová práce dále pojednává o postavení specifického veřejnoprávního ústavu v komparaci se soukromoprávním. V závěrečných částech práce analyzuje judikaturu a její dopady do výkladu postavení ústavu. Cílem této diplomové práce je pak provedení analýzy identifikovaných výkladových diskrepancí, které se od okamžiku přijetí nové občanskoprávní úpravy objevily. Práce čerpala především z účinné právní úpravy na tuzemské úrovni s příležitostným využitím zahraničních zdrojů. Dalšími zdroji byla odborná literatura, odborné články a další výkladové materiály. Tato diplomová práce představuje exkurz do problematiky ústavu a analyzuje dopady, které měla na vývoj této právnické osoby nová občanskoprávní úprava. Institute Abstract The thesis deals with the civil law regulation of the institute as an independent legal entity. In the context of the given issue, the thesis also analyses the extent to which the legislator managed to express the institute as a separate type of legal person in a relatively modest regulation. The thesis further analyses the individual provisions and the interpretative problems that the separation of the institute has brought. The thesis further discusses the status of a specific public law institute in comparison with a private law institute. In the final sections, the thesis analyses the case law and its implications for the interpretation of the status of the Institute. The aim of this thesis is then to analyse the identified interpretative discrepancies that have emerged since the adoption of the new civil law. The thesis drew primarily on the effective legislation at the domestic level. Other sources were literature, scholarly articles and other interpretative materials. This thesis presents an excursus into the issues of the Institute and analyses the effects that the new civil legislation has had on the development of this legal entity.
