Sousedská práva a jejich ochrana v teorii a praxi v českém právu v kontextu vybraných evropských právních úprav Abstrakt Hlavním cílem této práce je celkové obsáhnutí sousedských práv a jejich ochrany v rámci občanského zákoníku. V pěti kapitolách je komplexně popsána celá široká problematiku tohoto tématu, který historicky slouží jakožto specifická limitace vlastnického práva mezi osobami, které lze označit jako sousedy. Důraz je přitom kladen jak na historickou genezi tohoto institutu, tak na současnou právní úpravu, která znamenala do značné míry návrat k římskoprávním tradicím, které vyjadřoval především za období první republiky platný ABGB. Tato úprava výrazně mění celou soustavu sousedských práv v rámci občanského práva, a do značné míry překonává pojetí předcházejících občanských zákoníků účinných od r. 1. 1. 1950 do 31. 12. 2013. Zejména se jedná o komplexní rozšíření ochrany sousedských práv a výrazného zpřehlednění v rámci občanského zákoníku. Mnoho institutů ochrany sousedských práv se nadto do českého občanského zákoníku vrací (např. právo nezbytné cesty) a některá ustanovení se objevují i zcela nově (např. § 1020 OZ). Významná pozornost je přitom věnována rovněž procesním aspektům uplatňování ochrany sousedských práv a otázkám týkající se jejich praktické použitelnosti v rámci právních poměrů... Neighbour's rights and their protection in the theory and practice in context with the selected European legislation Abstract The main goal of this thesis is the complex description of the neighbour's rights and their protection in the effective Czech civil code, which is then compared with the selected foreign legislation. The wide variety of rules and regulations, which historically serve as specific limitations of proprietor's rights between persons who can be called neighbours, is comprehensively described in the five chapters of this work. The thesis emphasizes the historical elements of the topics, as well as current effective laws and regulations, which are nowadays based mainly upon historical traditions of Roman law, which was the main inspirational source for the ABGB, the last similar civil code effective in the time of The First Czechoslovak republic. The effective civil code significantly changed the system and depiction of the neighbour's rights and to a great extent surpasses previous conception of the civil codes effective from 1. 1. 1950 to 31. 12. 2013. The most important changes are bound with the broad extension of the protection of the neighbour's rights and significant clarification of its system in the current effective civil code.
