Právní aspekty generativní umělé inteligence V posledních letech jsme svědky pokroku v oblasti generativní umělé inteligence. Na trh byly uvedeny nástroje, které jsou schopny produkovat texty, obrázky, zvuk a videa, a to v kvalitě prakticky nerozpoznatelné od obsahu vytvořeného člověkem. Tento technologický pokrok s sebou přináší nové právní výzvy, které zahrnují otázky využívání autorských děl k trénování AI, problematiku deepfake, šíření dezinformací (fake news) a určování autorství výstupů generativní AI. Předkládaná rigorózní práce zhodnocuje současnou právní úpravu v České republice a na úrovni EU, která se snaží tyto otázky harmonizovat. V úvodu práce autor poskytuje mezioborový pohled na generativní umělou inteligenci, který propojuje technické a právní aspekty s cílem usnadnit pochopení této složité problematiky i osobám bez technického vzdělání. Kromě toho obsahuje práce výklad k relevantní právní úpravě, která se k této problematice vztahuje, a to především s důrazem na odvětví autorského práva. Těžištěm práce je tzv. "životní cyklus" generativní umělé inteligence. Autor provází čtenáře různými fázemi vývoje generativní umělé inteligence, od shromažďování a zpracování trénovacích dat až po samotnou fázi generování nového textu, obrázku nebo jiného obsahu. V každé fázi jsou identifikována... Legal Aspects of Generative Artificial Intelligence In recent years, we have witnessed significant advancements in generative artificial intelligence (AI). Tools have been introduced to the market that are capable of producing text, images, audio, or video at a level of quality that is virtually indistinguishable from content created by humans. This technological progress introduces new legal challenges, including the use of copyrighted works for AI training, issues surrounding deepfakes, the spread of misinformation (fake news), and determining authorship of AI-generated outputs. This rigorous thesis evaluates the current legal framework in the Czech Republic and at the European Union level, which seeks to harmonize these issues. At the outset, the author provides an interdisciplinary perspective on generative AI, connecting technical and legal aspects to facilitate the understanding of this complex issue for those without a technical background. In addition, the thesis offers an explanation of the relevant regulation, with a particular emphasis on copyright law. The core of the thesis is centered on the so-called "life cycle" of generative artificial intelligence.
