Tato diplomová práce zkoumá stav ochrany hospodářské soutěže v České republice, odhaluje její přednosti a nedostatky a navrhuje legislativní a metodické změny pro zvýšení její efektivity. Práce představuje teoretické základy, které se věnují definici klíčových pojmů, rozlišováním mezi nekalou soutěží a zneužíváním hospodářské soutěže a propojení českého soutěžního práva s komunitárním právem. Dále se zabývá rolí Úřadu pro ochranu hospodářské soutěže, jeho postupy při řízení a řešení přestupků a v neposlední řadě jednotlivými typy narušení hospodářské soutěže. Praktická část analyzuje data z výročních zpráv Úřadu pro ochranu hospodářské soutěže a konkrétní případy narušení soutěže. V práci je obsažen pohled na tuto problematiku samotného ústředního orgánu a následně i podniků, které jsou do téma hospodářské soutěže zainteresovány, a to prostřednictvím dotazníkového šetření. Toto šetření bylo zaměřeno na zjištění míry povědomí o pravidlech hospodářské soutěže, zkušeností s jejich porušováním a efektivitou zásahů Úřadu pro ochranu hospodářské soutěže. Výsledky veškerého zkoumání s následnými řešeními jsou zahrnuty v legislativních a metodických úpravách. Navržené změny mají za cíl zlepšit a zvýšit účinnost ochrany hospodářské soutěže v České republice prostřednictvím zapojení všech relevantních subjektů a implementace doporučených opatření. The main aim of this diploma thesis is to evaluate the current legal and regulatory mechanisms for the protection of economic competition, to identify their strengths and weaknesses, and on the basis of which to propose recommendations for improving and streamlining the protection of economic competition. The thesis presents the theoretical basics, which are reflected in the practical part. The practical part analyses data from the annual reports of the Office for the Protection of Economic Competition and specific cases of competition infringements. The thesis includes the perspective of the central authority and the companies through a questionnaire survey. The results are possible legislative and methodological adjustments, which include an assessment of the current functioning of economic competition protection. A number of adjustments have been proposed, which are aimed at the various entities. These entities are the legislators, who could consider minor adjustments to Act No. 143/2001 Coll., on the Protection of Economic Competition, and the Office for the Protection of Economic Competition, which could in certain cases reassess their decision-making practice and ensure that communication, education and decision-making processes are made more efficient. This is closely linked to other entities that prepare and approve the state budget, as the Office for the Protection of Economic Competition does not have the financial resources to ensure these things. The other entities are companies, which are at the heart of all competition-related activities. They should be actively involved in educating themselves on this issue. With the active involvement of all stakeholders and the subsequent implementation of the above-mentioned amendments, protection of economic competition could be improved and made more effective.
