Tato bakalářská práce se zabývá problematikou smluvních pokut. Práce je zaměřena na institut smluvní pokuty, přiměřenou výši smluvní pokuty, zásadu dobrých mravů a ustálenou soudní praxi. Součástí praktické části je rozbor judikátů a smluv souvisejících se smluvní pokutou. Závěr práce obsahuje doporučení pro podnikatele, k čemu přihlédnout při sjednávání smluvních pokut. This bachelor thesis deals with the issue of contractual penalties. This thesis is focused on the institute of contractual penalty, the appropriate amount of contractual penalty, the principle of good faith and established court practice. Part of the practical part is an analysis of case law and contracts related to the contractual penalty. The conclusion of the thesis contains recommendations for entrepreneurs, what to be aware of when negotiating contractual penalties.
