Tato bakalářská práce se zabývá velice aktuálním procesem redefinice znásilnění v ČR. Pomocí kvalitativního výzkumu přináší unikátní analýzu aktérů a diskurzu vedoucího k návrhu novely trestního zákona. Cílem práce je identifikovat klíčové aktéry, kteří sehráli největší roli v diskurzu, zkoumat, jak se k problematice staví a jak hodnotí spolupráci na cestě za lepší definicí znásilnění v ČR. Dosavadní definice znásilnění v tuzemsku totiž nezahrnuje velké procento znásilnění, která se dějí například kvůli tzv. zamrznutí oběti, kvůli kterému se oběť nemůže bránit. Část naší společnosti i orgánů trestního řízení často věří mnohým stereotypům a mýtům o sexuálním násilí a tuto problematiku bagatelizuje. Teoretická část se věnuje úvodu do problematiky a vymezení důležitých pojmů. Empirická část se opírá o data získaná z polostrukturovaných rozhovorů s klíčovými aktéry, jejich následnou analýzu a výsledky výzkumu. Výzkum označil za hlavní aktéry zejména neziskové organizace, Konsent a Amnesty International, a hlavní iniciátorky debat na politické rovině, Taťánu Malou a Kláru Kocmanovou. Výsledky výzkumu odhalily i některé aktéry proti redefinici a analyzují také úspěšnou politickou spolupráci na tématu redefinice znásilnění v ČR. Výzkum tak poskytuje skutečně unikátní náhled do aktuální problematiky očima... This bachelor's thesis deals with the very recent process of redefining rape in the Czech Republic. Through qualitative research, it provides a unique analysis of the actors and discourse leading to the proposed amendment of the Criminal Code. The aim of the thesis is to identify the key actors who have played the biggest role in the discourse, to examine how they approach the issue and how they evaluate the cooperation towards a better definition of rape in the Czech Republic. The existing definition of rape in the country does not include the huge number of rapes that happen, for example, due to the so-called freezing of the victim who cannot defend themselves. A part of our society and criminal justice authorities often believe many stereotypes and myths about sexual violence and downplay the issue. The theoretical part is devoted to an introduction to the issue and the definition of important concepts. The empirical part is based on data obtained from semi-structured interviews with key actors, their subsequent analysis and the results of the research. The research identifies the main actors as NGOs, Konsent and Amnesty International, and the main initiators of debates at the policy level, Taťána Malá and Klára Kocmanová.
