PRÁVNÍ ASPEKTY PLAY-TO-EARN (P2E) JAKO VÝDĚLEČNÉ ČINNOSTI 4 Anotace Tato diplomová práce je zaměřena na právní kvalifikaci nového obchodního modelu videoher, který na rozdíl od tradičního pojetí videoherní zábavy jako odpočinkové aktivity slibuje hráčům možnost dosahovat stabilně výdělečné činnosti. Pro tento model se v odvětví zažilo označení "play-to-earn" (P2E), neboli hraní za účelem výdělku, jehož výdělečný mechanismus je implemen- tován přímo ve zdrojovém kódu dané videohry. Na rozdíl od profesionálního hraní videoher za finanční odměnu, tzv. e-sportu, je model P2E postaven na odměňování skrze automatické generování kryptoaktiv (kryptoměn či uni- kátních digitálních tokenů známých pod zkratkou NFT). Hráč má následnou možnost s takto nabytými aktivy provádět transakce, včetně výsledné směny do zákonného platidla. Mechanismus hry probíhá automaticky skrze chytré smlouvy vybudované na distribuované účetní knize/síti, známé pod termí- nem "blockchain". V práci je tento fenomén zkoumán z několika právních aspektů, mezi které se řadí především právní problematika hazardu, pláno- vané evropské nařízení o kryptoaktivech (MiCA) a problematika daňová. Za účelem identifikace hazardu jsou poté v druhé části práce podrobeny dů- kladné analýze vybrané P2E hry, s následující kapitolou určenou k diskusi právní úpravy... PRÁVNÍ ASPEKTY PLAY-TO-EARN (P2E) JAKO VÝDĚLEČNÉ ČINNOSTI 5 Abstract This thesis focuses on the legal qualification of a new business model of video games, which, in contrast to the traditional conception of video game entertainment as a recreational activity, promises players the possibility of achieving a stable income. This model has come to be known in the industry as "play-to-earn" (P2E), where the earning mechanism is implemented di- rectly in the source code of the video game. Unlike professional video game play for financial reward, known as e-sports, the P2E model is based on re- warding through the automatic generation of crypto-assets (cryptocurren- cies or non-fungible tokens known as NFTs). The player is then able to trans- act with the assets thus acquired, including the resulting exchange into legal tender. The mechanism of the game runs automatically through smart con- tracts built on a blockchain. This thesis examines this phenomenon from sev- eral legal aspects, in particular the issue of gambling, the upcoming Euro- pean regulation on Markets in Crypto-assets (MiCA) and related Czech tax issues.
