Žaloba na doplnění pasiv Abstrakt Tématem diplomové práce je žaloba na doplnění pasiv. Cíl práce je dvojí, zaprvé podrobně zanalyzovat jednotlivé prvky institutu a zadruhé na základě provedené analýzy zhodnotit, zda institut naplňuje cíle či má alespoň potenciál naplnit cíle, s nimiž byl do českého právního řádu přejímán. Institut žaloby na doplnění pasiv je adaptací francouzské odpovědnosti za nedostatek aktiv (responsabilité pour insuffisance d'actif), z toho důvodu je kromě metody deskripce, analýzy a částečně i syntézy v práci užito také metody komparace. Metody komparace je užito rovněž při srovnání s institutem sankčního ručení, který institut žaloby na doplnění pasiv nahradil. Diplomová práce je rozdělena na úvod, šest kapitol a závěr. V první kapitole diplomantka zařazuje institut do souvislostí a vymezuje tak postavení institutu jako tzv. úpadkového deliktu, jeho funkce a povahu. V této kapitole diplomantka dále v obecnosti uvádí francouzskou právní úpravu a vymezuje některé pojmy francouzského insolvenčního práva, se kterými pracuje dále v textu. Kapitoly druhá až čtvrtá jsou věnovány analýze institutu, k níž diplomantka mimo jiné využívá judikatury francouzského Kasačního soudu (Cour de Cassation). V druhé kapitole diplomantka analyzuje podmínky pro uložení zvláštní povinnosti, jež je podstatou... 1 Action for the replenishment of the liabilities Abstract The topic of the diploma thesis is an action for the replenishment of the liabilities. The aim of the work is twofold, firstly to analyse in detail the elements of the institute and secondly, based on the analysis performed, to evaluate whether the institute fulfils the goals or at least has the potential to fulfil the goals with which it was adopted into the Czech legal order. The institute of an action for the replenishment of the liabilities is an adaptation of the French liability for deficiency in assets (responsabilité pour insuffisance d'actif), for this reason, in addition to the method of description, analysis and partially also synthesis, the method of comparison is also used in the work. The method of comparison is also used when comparing with the institute of sanction liability, which was replaced by the institute of an action for the replenishment of the liabilities. The diploma thesis is divided into an introduction, six chapters and a conclusion. In the first chapter, the author places the institute in context and thus defines the position of the institute as a so-called bankruptcy tort, its functions and nature.
