Ochranné známky a jejich právní ochrana v České republice Abstrakt Tématem této rigorózní práce jsou ochranné známky a jejich právní ochrana v České republice. Popisuje právní úpravu ochranných známek, jejich historii a vývoj, a zaměřuje se zejména na změny zavedené novelou zákona o ochranných známkách účinnou od 1. 1. 2019. Cílem této práce je komplexně analyzovat současnou právní úpravu ochranných známek se zaměřením na proces registrace ochranných známek, zhodnotit novelu zákona o ochranných známkách účinnou od 1. 1. 2019, vysvětlit vztah mezi ochrannou známkou České republiky a ochrannou známkou Evropské unie a vysvětlit proces vymáhání práv z ochranné známky. K dosažení tohoto cíle je nutné vysvětlit tuto problematiku s ohledem na historický vývoj ochranných známek (nejen) v České republice a s ohledem na judikaturu českých soudů a Soudního dvora Evropské unie. Tato diplomová práce je po obsahové stránce rozdělena do čtyř kapitol. První z nich se zabývá ochrannými známkami obecně - tedy jejich právní úpravou, samotným pojmem "ochranná známka", její funkcí, druhy a zápisnou způsobilostí. Druhá kapitola upravuje přihlášku ochranné známky a řízení o přihlášce. Na začátku kapitoly je obecně popsán proces registrace ochranné známky. Zásadní část představují důvody pro zamítnutí ochrany a vysvětlení práva... Trademarks and their legal protection in the Czech Republic Abstract The subject-matter of this thesis is trademarks and their legal protection in the Czech Republic. It describes the legal regulation of trademarks, their history and development, and focuses in particular on the changes introduced by the amendment to the Trademark Act effective from 1 January 2019. The aim of this thesis is to comprehensively analyse the current legal regulation of trademarks with a focus on the trademark registration process, to evaluate the amendment to the Trademark Act effective from 1 January 2019, to explain the relationship between the trademark of the Czech Republic and the trademark of the European Union and to explain the process of enforcement of trademark rights. In order to achieve this objective, it is first necessary to consider the historical development of trademarks (not only) in the Czech Republic and with regard to the case law of the Czech courts and the European Court of Justice. This thesis is divided into four chapters. The first one concerns trademarks in general - i.e. their legal regulation, the term "trademark" itself, their function, types and registrability.
