Bakalářská práce porovnává efektivitu veřejných a soukromých soudů v České republice. Úvod práce se zabývá teorií poskytování ekonomických statků, dále pak argumentací zastánců a oponentů jejich poskytování státem. Následuje exkurs do fungování konkurence při tvorbě práva a historické ohlednutí se zaměřením na historii soukromého poskytování a vynucování práva ilustrovaného na středověkém Islandu, Divokém Západě, Anglii a českých zemích. Hlavní cíl si tato práce vytyčila v porovnání efektivity soukromého a veřejného soudnictví v České republice. Konkrétně se zaměřuje na efektivitu v rozhodování občanskoprávních sporů, kde klasickým veřejným soudům konkurují soukromé rozhodčí soudy. Z výsledků analýzy jednoznačně plyne větší efektivita soukromé varianty. Konec práce analyzuje výsledky tohoto porovnání a pokouší se zjistit, v čem tkví problémy, nebo naopak úspěchy těchto alternativ. This bachelor thesis is comparing the public courts with private courts in the Czech Republic. Introducion of this bachelor thesis is focused on the theory of providing economics goods and then stickler's and adversary's argumentation for the public administration. The following part contains excurcus to operating principle of competition in formation law and private administration and exaction in medieval Iceland, Wild West, England and Bohemia. The main part of work is an analysis of efficiency of private and public courts in civil cases in the Czech Republic. The results of this analysis says that private courts are more efficient. The end of this thesis answers why are private courts more efficient.
