5050 Resumé Kolektivní investování a jeho právní úprava Kolektivní investování v České republice zaznamenalo v posledním desetiletí ohromný vzestup, který byl zapříčiněn mimo jiné i obnovením důvěry v právní úpravu, která zajišťuje investorům bezpečnost jejich investice. Jelikož se jedná o téma relativně složité a bezpochyby zajímavé, vybral jsem si jej za téma své diplomové práce. Tato práce je členěna do kapitol a podkapitol obsahující jednotlivá témata týkající se právní úpravy kolektivního investování, avšak tak, aby zůstala zachována celková logická struktura problematiky. Před započetím s psaním diplomové práce jsem diskutoval s praktikujícími advokáty nejpalčivější problémy praktické aplikace právní úpravy kolektivního investování, jelikož tento náhled mi z akademické přípravy chyběl. Z tohoto krátkého výzkumu jsem se dozvěděl nejčastější problémy spojené s úpravou kolektivního investování, které jsem rozebral v této diplomové práci. Mezi ně patří především vymezení veřejnosti podle zákona o kolektivním investování, možnost nabízení služeb uzavřených zahraničních fondů v České republice a nově zaváděná právní regulace standardních a alternativních fondů. Za tímto účelem jsem prostudoval dostupnou literaturu včetně příspěvků v odborných časopisech a stanovisek České národní banky, Ministerstva financí... 5252 Abstract Collective investment and its legal regulation In the Czech Republic the collective investment has experienced a huge expansion in the last decade which was caused among others by renewing the trust in legal regulation which ensures the safety of investment to the investors. Because the topic is relatively difficult and undoubtedly interesting I chose it as a topic of my diploma thesis. This paper is divided into chapters and subchapters containing particular topics regarding the collective investment legislation but to maintain the overall logical structure of the issue. Before starting to write the diploma thesis I discussed the biggest problems of a practical application of the collective investment legal regulation with practising lawyers as this view from the academic preparation was missing. I found out from this short survey the most common problems connected with the collective investment legal regulation which I discussed in this diploma thesis. These include in particular the definition of public offering under the Collective Investment Act, the possibility to offer the services of closed-end foreign funds in the Czech Republic and the recently introduced legislation regarding standard and alternative funds.
