1 Abstrakt: Výjimky a omezení autorského práva s přihlédnutím k on-line prostředí Tato práce se zaměřuje na problematiku výjimek a omezení v oblasti autorského práva, s důrazem na jejich aplikaci v digitálním prostředí, zejména na internetu. Výjimky a omezení jsou klíčovými aspekty autorského práva, které se staly středem pozornosti především v kontextu neustálého technologického vývoje a digitální revoluce. Práce analyzuje evropskou autorsko-právní úpravu, zejména s ohledem na nedávnou implementaci směrnice o autorském právu na jednotném digitálním trhu (DSM směrnice) do českého právního systému v roce 2023. Práce se nejprve věnuje definici a racionálním základům výjimek a omezení, přičemž srovnává různé přístupy, včetně anglo-americké a evropské právní kultury. Autor také zkoumá možnosti propojení těchto přístupů, zejména implementaci otevřených klauzulí do evropského katalogu výjimek a omezení. Další část práce se věnuje "tříkrokovému testu" jako legislativnímu limitu pro přijímání nových výjimek a omezení. Tento institut má význam jak na legislativní úrovni, tak při aplikaci autorského práva. Jádrem práce jsou analýzy čl. 5 odst. 1 směrnice o informační společnosti z roku 2001, která se týká výjimky pro dočasné technické rozmnoženiny, a nově přijatých výjimek pro účely textového a datového těžení (TDM)... 1 Abstract: Copyright exceptions and limitations with regard to the online environment This thesis focuses on the concerns of copyright law exceptions and limitations, with a focus on how they apply in the digital world, especially on the internet. Key elements of copyright law, such as exceptions and limitations, have come under increased examination, particularly in light of current technical developments and the digital revolution. The directive on copyright in the Digital Single Market (DSM Directive), which will be incorporated into Czech law in 2023, is a recent development that is examined in the thesis' analysis of European copyright law. The thesis compares diverse techniques, including those from Anglo-American and European legal traditions, to define and explain exceptions and limitations. The author also looks into how these techniques may be combined, especially how open clauses might be added to the European list of exclusions and limitations. The "three-step test" is looked at in another section of the thesis as a legislative ceiling for the addition of additional exceptions and restrictions. Both at the legislative level and in the implementation of copyright law, this institute is significant.
