[cze][eng] práce "Právo na inkluzivní vzdělávání" Práce se zabývá problematikou inkluze ve vzdělávání, a to zejména jejím právním zakotvením a posouzením, nakolik je právo na inkluzivní vzdělávání možné charakterizovat jako základní lidské právo. Po úvodu, vymezení subjektu a předmětu práva na inkluzivní vzdělávání (vč. mezinárodního kontextu), popisu jeho zákonného zakotvení a přiblížení některých okolností ve vztahu k jeho zavádění v ČR je vyhodnoceno právo na inkluzivní vzdělávání vzhledem k ústavnímu pořádku ČR. A to bez zahrnutí mezinárodních lidskoprávních smluv, které jsou studovány v následujících dvou kapitolách. Zvláštní pozornost je v této souvislosti věnována problematice tzv. konkursního nálezu Ústavního soudu a málo řešené otázce jeho časové působnosti. Kromě pozitivního práva jsou v práci zohledněna i některá rozhodnutí Ústavního soudu a českých obecných soudů. Ve vztahu k mezinárodním smlouvám o lidských právech je věnována významná pozornost i rozhodnutím relevantních mezinárodních orgánů, zejména pak Evropského soudu pro lidská práva. Rozhodovací praxe Evropského soudu pro lidská práva totiž nejenže poskytuje mnohé argumenty ve vztahu k posouzení existence základního lidského práva na inkluzivní vzdělávání, ale indikuje i možný vývoj ve vztahu k problematice hospodářských, sociálních a...of thesis "The right to inclusive education" The thesis deals with the issue of inclusion in education, especially its legal protection and the assessment of the extent to which the right to inclusive education can be characterized as a fundamental human right. After the introduction, definition of the subject and object of the right to inclusive education (including the international context), description of its legal provision and some circumstances in relation to its implementation in the Czech Republic, the right to inclusive education is evaluated in relation to the constitutional order of the Czech Republic. The international human rights treaties are studied in the following two chapters. Special attention is paid in this context to the issue of the so-called bankruptcy judgement of the Czech Constitutional Court and the rarely concerned question of its temporal scope. In addition to positive law, some decisions of the Constitutional Court and Czech general courts are also taken into account. In relation to international human rights treaties, significant attention is also paid to the decisions of international bodies, in particular the European Court of Human Rights.
