Ukládání trestů při souběhu a recidivě Abstrakt Tato diplomová práce se zabývá ukládáním trestů při souběhu trestných činů, recidivě a s nimi související nepravé recidivě. Cílem práce je provést komplexní analýzu platné právní úpravy na základě rozboru zákonné úpravy, související judikatury a odborných publikací, a následně doplnit tento rozbor o vlastní úvahy a návrhy de lege ferenda autorky této práce. Česká právní úprava je dále porovnána s právní úpravou italskou, jež demonstruje jiný přístup k trestání souběhu a recidivy. Práce byla vypracována za použití popisné, analytické, syntetické a výkladové metody, a to zejména za použití výkladu jazykového a teleologického. Použita byla rovněž komparativní metoda, a to zejména při komparaci české a italské právní úpravy. Ze strukturálního hlediska je práce rozdělena na čtyři kapitoly. První kapitola práce se zabývá vymezením pojmů souběh trestných činů, recidiva a dále též nepravá recidiva, přičemž poukazuje na vybrané problémy, vznikající při rozlišování těchto forem mnohosti trestné činnosti. Druhá kapitola práce analyzuje právní úpravu ukládání trestů při souběhu trestných činů, zejména pak posouzení souběhu jako přitěžující okolnosti a ukládání úhrnného a souhrnného trestu, včetně vymezení problematických aspektů právní úpravy ukládání trestů při souběhu.... The imposition of penalties on the concurrence of crimes and recidivism Abstract This final thesis deals with the imposition of penalties on the concurrence of crimes, recidivism and related quasi-recidivism. The aim of the thesis is to comprehensively analyse the current legal regulation on the basis of an analysis of the statutory regulation, the related case law and professional publications, and to supplement this analysis with the own considerations and de lege ferenda proposals of the author of this thesis. Furthermore, the Czech legal regulation is compared with the Italian legal regulation, which demonstrates a different approach to punishing concurrence and recidivism. The thesis has been written using the descriptive, analytical, synthetic and interpretative methods, especially linguistic and teleological interpretation. The comparative method was also used, in particular for comparing the Czech and Italian legal regulations. Structurally, the thesis is divided into four chapters. The first chapter of the thesis deals with the definition of the terms concurrence of crimes, recidivism, and also quasi-recidivism, while pointing out selected issues, which occur while distinguishing these forms of multiple offences.
