Specifika sporů o nahrazení projevu vůle povinné osoby dle zákona o půdě Abstrakt Tato práce pojednává o povaze a účincích civilních rozsudků, na základě kterých jsou na oprávněné osoby podle zákona o půdě převáděny náhradní pozemky, a to jako náhrada za původní pozemky odňaté, ke kterým nebylo možné obnovit vlastnické právo. Cílem je rovněž podat ucelený výklad o specifikách náhradových sporů a zároveň analyzovat, zdali tato specifika odůvodňují konstitutivní povahu náhradových rozsudků. Pro zachovávání ucelenosti a úplnosti se zaměřuje jak na procesní problematiku, tak v nutné míře i na související problematiku hmotněprávní. V práci jsou do značné míry rovněž rozebírány a hodnoceny právní názory rozhodovací praxe, jíž autor zároveň v konfrontoval s konkurenčními úvahami, právními názory a vlastními argumenty. Diplomová práce je rozdělena do osmi kapitol. Obsah první kapitoly je věnován nezbytnému a stručnému úvod do problematiky zemědělských restitucí podle zákona o půdě. Tato materie je nutná pro pochopení souvislostí a základů pro pojednání o sporech k náhradnímu uspokojení restitučního nároku. Rovněž se kapitola zabývá vznikem restitučního nároku a způsoby jeho uspokojení. Druhá kapitola pojednává o povaze náhradových sporů a výkladovém principu in favorem restitutionis. Pojednání o podmínkách... 1 Specifics of disputes on the substitution of the will of the obliged person under the Land Act Abstract This thesis deals with the nature and effects of the judgments as a basis for transferring ownership of corresponding lands as a replacement for lands to which the ownership right could not be restored. The aim is also to give a comprehensive interpretation of the specifics of replacement disputes and at the same time to analyse whether these specifics determine the constitutive nature of replacement judgments. In order to be consistent and complete, the thesis focuses on procedural issues as well as, to the extent necessary, on related substantive issues. The thesis also analyses and evaluates the legal opinions of the case law, which the author also confronts with competing considerations, legal opinions and his own reasoning. The thesis is divided into eight chapters. The content of the first chapter is devoted to a necessary and brief introduction to the issue of agricultural restitution under the Land Act. This matter is necessary to understand the context and the basis for the discussion of disputes for the substitute enforcement of the restitution claims.
