Právní a mimoprávní faktory v argumentaci a rozhodování Ústavního soudu České republiky Abstrakt Práce se věnuje vlivu právních a mimoprávních faktorů na rozhodování Ústavního soudu České republiky. Konkrétně se pak zaměřuje na otázky, jaké předpoklady pro rozhodování Ústavnímu soudu vytváří vnější politické a společenské prostředí, jak se v tomto rozhodování odráží odlišné postoje a přístupy jednotlivých soudů a jaký vliv na něj má složení soudních senátů. Autor nejprve shrnuje širokou škálu faktorů, u nichž byl pozorován vliv na rozhodování soudů. Mezi ně patří nejen obsah právní úpravy, ale také soudcovské filosofie včetně aktivismu a sebeomezení, a nejrůznější mimoprávní faktory, na něž poukazuje například tzv. postojový a strategický model soudního rozhodování, ale také psychologické a ekonomické studie. Následně se již práce věnuje samotnému Ústavnímu soudu ČR. Nejprve se zaměřuje na předpoklady pro působení různých faktorů na jeho rozhodování a argumentuje tak, že Ústavní soud lze díky vnějším podmínkám i jeho vlastní rozhodovací činnosti považovat za silný soud. Poté se práce postupně za pomoci statistické metody i analýzy obsahu rozhodnutí zaměřuje na prezentaci rozhodnutí Ústavního soudu prostřednictvím tiskových zpráv, na roli složení senátu v rozhodování ústavních stížnostech, a na vliv... Legal and Extralegal Factors in Argumentation and Decision-making of the Constitutional Court of the Czech Republic Abstract The thesis deals with the influence of legal and extralegal factors on the decision-making of the Constitutional Court of the Czech Republic. Particularly, it focuses on the questions of which preconditions for decision-making of the Constitutional Court are created by the external political and social environment, how this decision-making reflects the different attitudes and approaches of individual judges and how it is influenced by the composition of the judicial panels. The author first summarizes a wide range of factors whose influence on court decisions has been observed. These include not only the content of legislation, but also judicial philosophy, including activism and self-restraint, and various extralegal factors observed by the attitudinal and strategic model of judicial decision-making, but also by psychological and economic studies. Subsequently, the thesis focuses on the Constitutional Court of the Czech Republic.
