Diplomová práce se zabývá úpravou povinností prodávajícího ve Vídeňské úmluvě o smlouvách o mezinárodní koupi zboží. Vídeňská úmluva byla přijata na půdě OSN v roce 1980 a od té doby byla ratifikována 95 státy z celého světa. Jejím obsahem je unifikovaná hmotněprávní úprava mezinárodní kupní smlouvy, což je základní smluvní typ mezinárodního obchodu. Vídeňská úmluva tak svým obsahem a popularitou představuje nejdůležitější unifikační počin v oblasti mezinárodního obchodu. Diplomová práce si klade za cíl popsat a analyzovat úpravu povinností prodávajícího, která tvoří centrální část Vídeňské úmluvy. Základním principem Vídeňské úmluvy je jednotný výklad, který zajišťuje, že bude aplikována stejným způsobem soudy a rozhodčími tribunály po celém světě. Práce se zaměřuje na identifikaci tohoto jednotného režimu a činí tak analýzou a komparací české a zahraniční literatury a judikatury. Práce se dělí na tři části. První kapitola se zabývá obecnou charakteristikou Vídeňské úmluvy. Je rozebrána historická geneze Vídeňské úmluvy na pozadí snahy o unifikaci mezinárodního obchodního práva. Dále je charakterizována hmotněprávní úprava a její vztah ke smluvní autonomii stran. Přiblíženy jsou také působnost a výklad Vídeňské úmluvy jako prerekvizity nezbytné pro další práci s jejím textem. Finálně jsou... The thesis deals with the regulation of the seller's obligations in the Vienna Convention on Contracts for the International Sale of Goods. The Vienna Convention was adopted by the United Nations in 1980 and has since been ratified by 95 countries from around the world. It contains a unified substantive regulation of an international sales contract, which is the basic contractual type of international trade. With its content and popularity, the Vienna Convention represents the most important unification act in the field of international trade. The thesis aims to describe and analyse the regulation of the seller's obligations, which forms the central part of the Vienna Convention. The basic principle of the Vienna Convention is uniform interpretation, which ensures that it will be applied in the same way by courts and arbitral tribunals around the world. The thesis focuses on the identification of this unified regime and does so by analysing and comparing Czech and foreign literature and case law. The thesis is divided into three parts.
