Problematika rozdílu mezi přiměřenou dobou na oddech a jídlo (jídlo a odpočinek) a přestávkou na jídlo a oddech (jídlo a odpočinek) dle příslušných ustanovení zákona č. 262/2006 Sb., zákoníku práce, v platném znění a dle zákona č. 361/2003 Sb., zákona o služebním poměru, v platném znění Abstrakt Diplomová práce se zabývá problematikou, jež je stále veskrze aktuální, neboť toho času nejen v České republice, ale prakticky v celé Evropské unii vedou zaměstnanci, resp. pří- slušníci bezpečnostních sborů spory o tom, zda není jejich ze strany zaměstnavatele stano- vená údajná přestávka v práci (službě), tedy jinými slovy doba odpočinku, ve skutečnosti pracovní dobou. Přitom ve snaze obhájit svoji pozici se každá ze stran sporu snaží doložit, proč tyto "přestávky" (ne)nesou znaky pracovní doby. To by v kontextu terminologie záko- níku práce a zákona o služebním poměru znamenalo, že jim místo přestávky v práci (službě) měla být zajištěna alespoň tzv. přiměřená doba na oddech a jídlo (jídlo a odpočinek), protože z jejich strany vykonávanou práci nelze z různých důvodů přerušit. Za tu však takovým za- městnancům a příslušníkům náleží i odměna, a to právě z toho důvodu, že jde ve skutečnosti o pracovní dobu, resp. dobu služby, totiž o dobu přesčas. Tato práce si tak klade za cíl čtenáři tuto úvahu přiblížit,... The issue of the difference between the reasonable time for rest and food and the work break under the relevant provisions of Act No. 262/2006 Coll., the Labour Code, as amended, and Act No. 361/2003 Coll., the Service Relationship of Security Force Mem- bers Act, as amended Abstract This thesis addresses the still relevant issue - demonstrated by the ongoing disputes of employees and members of the security forces in the Czech Republic and essentially the entirety of the European Union - of whether their alleged work break, i.e. rest time, does in fact constitute working time. To defend their respective positions, each party to the dispute tries to prove why these "work breaks" do or do not constitute working time. In the context of the terminology of the Labour Code and the Service Relationship of Security Force Mem- bers Act this would mean that instead of work breaks, such employees should be provided with so-called "reasonable time for rest and food", as the work performed cannot, for various reasons, be interrupted. Those employees are accordingly entitled to remuneration for that time, precisely because it is in fact working time, hence overtime.
