Cílem bakalářské práce bude zmapovat postupy pracovníků Probační a mediační služby ČR jak v trestním řízení vedeným s mladistvými pachateli trestné činnosti, tak i v rámci jejich resocializace. Práce bude rozdělena na část teoretickou a část praktickou. V teoretické části autor vymezí základní právní pojmy v oblasti soudnictví mládeže, rozdílnost koncepcí retributivní a restorativní justice, problematiku trestání a ukládání výchovných opatření mladistvým pachatelům a vnějšího hodnocení jejich činnosti pohledem Probační a mediační služby ČR a orgánu sociálně-právní ochrany dětí v řízení v trestních věcech mladistvých. V praktické části bude zkoumáno metodou kvalitativní analýzy pomocí polostrukturovaných rozhovorů provedených jednak s probačními úředníky a jednak s mladistvými pachateli, kteří absolvovali akreditované resocializační programy. Výzkum bude zaměřen na postoje a proces resocializace této skupiny osob. Zejména bude věnována pozornost otázkám, jak jsou tyto programy vnímány, hodnoceny samotnými mladistvými osobami, a jaký měly vliv na jejich další život. Výběrový soubor budou tvořit klienti a pracovníci Probační a mediační služby ČR v Jindřichově Hradci, Třebíči, Táboře a v Českých Budějovicích. The aim of the bachelor thesis is to map the procedures of the Probation and Mediation Service of the Czech Republic both in criminal proceedings conducted with juvenile offenders and in their re-socialization. The work will be divided into theoretical and practical part. In the theoretical part, the author defines the basic legal concepts in the field of youth justice, the diversity of concepts of retributive and restorative justice, the issue of punishment and imposition of educational measures for juvenile offenders and external evaluation of their activities from the wiew of Probation and Mediation Service of the Czech Republic and Authority for social and legal protection of children and juveniles. The practical part will be investigated by the method of qualitative analysis of structured interviews with probation officers and with juvenile offenders, who undergo accredited re-socialization programs, their attitudes and the process of their re-socialization. In particular, attention will be paid to the question of how these programs are perceived, evaluated by minors themselves, and how they have influenced their lives. The sample will consist of clients and staff of the Probation and Mediation Service of the Czech Republic in Jindřichův Hradec, Třebíč, Tábor and České Budějovice.
