- VÝVOJ ROZHODOVÁNÍ V OBLASTI ZADÁVÁNÍ VEŘEJNÝCH ZAKÁZEK Jak samotný název disertační práce napovídá, jejím obsahem je analýza rozhodování v oblasti veřejných zakázek včetně jeho vývoje. Disertační práce je rozčleněna do tří stěžejních kapitol, a to na obecné poznatky k právní úpravě přezkumu postupu zadavatelů, konkrétní analýzu rozhodovací praxe a návrhy právní úpravy de lege ferenda. V obecné části se disertantka zaměřila jak na vnitrostátní přezkum, tak na dohled nad zadáváním veřejných zakázek ze strany unijních orgánů. Disertantka se věnovala zejména popisu návrhového řízení a řízení ex offo, ukládání nápravných opatření a také právní úpravě přestupků. V kapitole věnující se shrnutí obecné právní úpravy disertantka taktéž stručně popsala roli ÚOHS a vnitrostátních správních soudů, stejně jako roli Ústavního soudu. V kapitole věnující se rozhodovací praxi na úseku zadávání veřejných zakázek, která je stěžejní částí disertační práce, disertantka provedla analýzu vydaných rozhodnutí zejména v období po nabytí účinnosti nového zákona o zadávání veřejných zakázek. Popisovaná kapitola je rozdělena na dvě části, a to na část analyzující procesněprávní otázky a část popisující otázky hmotněprávní. The dissertation is divided into three main chapters, namely the general conclusions on the legal regulation of the review of the procedure of contracting authorities, a specific analysis of decision-making practice and proposals for legal regulation de lege ferenda. In general, the dissertation focused on both national review and the supervision of public procurement by the EU institutions. The dissertant focused mainly on the description of the motion proceedings and ex officio proceedings, the imposition of corrective measures and also the legal regulation of offenses. In the chapter on the summary of general legislation, the dissertant also briefly described the role of the The Office for the Protection of Competition ("Office") and national administrative courts, as well as the role of the Constitutional Court. In the chapter on decision-making practice in the field of public procurement, which is a key part of the dissertation, the dissertation analyzed the issued decisions, especially in the period after the entry into force of the new Public Procurement Act.
