Právní aspekty a povaha výkonu majetkových práv autorských Abstrakt Diplomová práce se zabývá právem výkonu majetkových práv autorských osobou odlišnou od autora v poměrech právního řádu České republiky. Analyzuje povahu tohoto svébytného práva upraveného v § 58 autorského zákona z hlediska jeho zařazení v systému soukromého práva a z toho vyplývajících klíčových charakteristik. Zkoumá postavení vykonavatele majetkových práv, coby osoby vynakládající investici do tvorby autorů a integrující proces zhotovování složitých a komplexních děl, který nabývá na významu zejména v souvislosti s vývojem investičně náročných IT systémů chráněných jako autorské dílo. Práce se snaží zachytit komplexitu autorskoprávní problematiky při tvorbě rozsáhlých děl a mapuje všechny v úvahu připadající situace, při nichž může docházet k transferu práva výkonu na osobu označovanou autorským zákonem za zaměstnavatele. Do popředí výzkumu se dostávají zejména díla vytvořená více spoluautory, kteří své příspěvky tvoří na základě různých smluvních titulů, z nichž jim plynou povinnosti ve vztahu k různým zaměstnavatelům podílejícím se na procesu vzniku díla. K rozboru a hodnocení stávající právní úpravy práce přistupuje z pohledu uživatelské praxe. Akcent je kladen především na ty dílčí aspekty platného práva, jež mohou působit výkladové... Legal aspects and the nature of the exercise of author's economic rights Abstract The thesis concerns the right to exercise author's economic rights by a person other than the author in the legal system of the Czech Republic. It analyses the nature of this peculiar right regulated in § 58 of the Copyright Act in terms of its classification in the system of private law and the resulting key characteristics. The thesis examines the position of the executor of author's economic rights, as a person investing in the creation of works of autorship and integrating the process of creating complex works. This is gaining importance especially in connection with the development of investment-intensive IT systems protected by copyright. The thesis seeks to capture the complexity of copyright issues in the creation of large- scale works and maps out all relevant situations in which the right to exercise author's economic rights may be transferred to a person referred to as an employer under the Copyright Act. In particular, the research focuses on works created by multiple co-authors who make their contributions to work under different titles, which impose obligations on them in relation to the various employers involved in the process of creating the work.
