Název práce v českém jazyce Manželství z hlediska občanského a kanonického práva Abstrakt Manželství představuje významný právní institut, který se dotýká velkého množství obyvatelstva, neřku-li všech. Manželství tak, jak ho známe v dnešní podobě, se vyvinulo z církevního manželství a nejen proto jsou oba typy manželství, které dnes existují vedle sebe se vzájemným respektem, v mnoha ohledech velmi podobné. Cílem této práce je popsat a rozebrat oba typy, vzájemně je porovnat a učinit srovnání s důrazem na odchylky mezi oběma manželstvími. Cíle a účel práce jsou obsaženy v jejím Úvodu a úspěšnost naplnění cílů v Závěru. V první části (kapitoly 1 a 2) se autor věnuje výlučně občanskoprávnímu manželství od jeho historického vývoje a právních pramenů, přes fázi předcházející vzniku manželství a svatební obřad představující vznik manželství, až po jeho zánik. Nezanedbatelnou část tvoří též procesní aspekty rozvodového řízení, které představuje zcela zvláštní typ civilního řízení. Druhá část práce, která sestává z kapitol 3 a 4, se zaobírá manželstvím dle kanonického práva. Marriage as we know it today evolved out of church marriage, and it is not only because of this that the two types of marriage that exist side by side with mutual respect for each other today are very similar in many ways. The purpose of this study is to describe and analyse the two types of Marriage, compare them to each other, and make comparisons with a focus on the variations between the two marriages. The objectives and purpose of the study are stated in the Introduction and the success of the objectives in the Conclusion. In the first part (chapters 1 and 2), the author focuses exclusively on civil marriage, from its historical development and legal sources, through the phase preceding the formation of marriage and the wedding ceremony representing the creation of marriage, to its dissolution. A significant part is also dedicated to the procedural aspects of divorce procedure, which represent a completely special type of civil procedure.
