- 104 - NÁZEV PRÁCE, ABSTRAKT A KLÍČOVÁ SLOVA Alternativy nepodmíněného trestu odnětí svobody Tato diplomová práce se věnuje alternativám k nepodmíněnému trestu odnětí svobody. Hlavním cílem této práce je poskytnout komplexní analýzu alternativních trestů a východisek jejich ukládání. Práce obsahuje detailní rozbor jednotlivých alternativních trestů včetně jejich historického kontextu, specifik ukládání, výkonu i dohledu nad jejich výkonem. V rámci zachování celistvosti tématu je v první část nabídnut vhled do problematiky trestání a je zde vymezen účel trestu obecně. Pozornost je věnována i popsání nepodmíněného trestu odnětí svobody, které je nutné k bližšímu pochopení konceptu alternativních trestů i k porovnání kladů a záporů jednotlivých úprav. Největší důraz je v této diplomové práci kladen na poskytnutí podrobného rozboru alternativ k nepodmíněnému trestu odnětí svobody, které jsou způsobilé bezezbytku nahradit nepodmíněný trest odnětí svobody. Konkrétně se jedná o podmíněné odsouzení k trestu odnětí svobody, podmíněné odsouzení k trestu odnětí svobody s dohledem, domácí vězení, peněžitý trest a trest obecně prospěšných prací. Pozornost je však věnována i všem dalším alternativním trestům, které současný český trestní zákoník nabízí. Pro úplnost jsou zde uvedeny i tresty, které nelze vnímat přímo... - 105 - THESIS TITLE, ABSTRACT AND KEYWORDS Alternatives to unconditional imprisonment This master thesis focuses on alternatives to unconditional imprisonment. The main objective of this thesis is to provide a comprehensive analysis of alternative sentences and the basis for their imposition. The thesis includes a detailed analysis of each alternative punishment, including its historical context, the specifics of its imposition, execution and supervision. In order to maintain the integrity of the topic, the first part offers an insight into punishment and defines the purpose of punishment in general. Attention is also paid to the description of unconditional imprisonment, which is necessary to further understand the concept of alternative sentences as well as to compare the pros and cons of different arrangements. The greatest emphasis in this thesis lies on providing a detailed analysis of alternatives to unconditional imprisonment that are capable of fully replacing the unconditional imprisonment. Specifically, these include suspended imprisonment, suspended imprisonment with supervision, house arrest, financial penalty and community service.
