Vybrané instituty Úmluvy Rady Evropy o prevenci a potírání násilí na ženách a domácího násilí ve světle mezinárodní praxe Tato práce rozebírá Úmluvu Rady Evropy o prevenci a potírání násilí na ženách a domácího násilí (Istanbulské úmluvy), přičemž se zaměřuje na mezinárodní praxi a pozoruje dopady Istanbulské úmluvy ve státech, které ji v současné době již ratifikovaly. Práce se zabývá tématy upravenými Istanbulskou úmluvou, která bývají v našem prostředí podrobována kritice a označována za kontroverzní. Cílem práce je posoudit, zda je tato kritika oprávněná a ratifikace Istanbulské úmluvy může způsobit některé jí vytýkané následky, nebo zda lze takovou kritiku vyvrátit, a to na základě zhodnocení mezinárodní praxe. Zkoumanými okruhy jsou přidaná hodnota Istanbulské úmluvy, její hodnotová neutrálnost a konečně její možné dopady v oblasti migračního práva. V rámci prvního okruhu je rozebrána jednak pozice Istanbulské úmluvy v rámci obdobných lidskoprávních mezinárodních smluv a obecně úprava tématu násilí na ženách a domácího násilí v oblasti mezinárodního práva. Dále se práce zabývá závazky plynoucími z ratifikace Istanbulské úmluvy a jejich dopady v zemích, které již tuto úmluvu přijaly a aplikují ji. Ve druhém okruhu jsou zkoumána ideová východiska Istanbulské úmluvy, konkrétně zda je či není... 1 Abstract Selected institutes of the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence in the Light of International Practice This work analyzes the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence (Istanbul Convention), focusing on international practice and observing the implications of the Istanbul Convention in countries that have already ratified it. The work focuses on topics regulated by the Istanbul Convention, which are often criticized in our environment and described as controversial. The aim of this work is to assess whether such criticism is justified and the ratification of the Istanbul Convention may cause some of the consequences the critique is afraid of, or to refute such criticism, based on the evaluation of international practice. The areas examined are the added value of the Istanbul Convention, its ideological neutrality and, finally, its possible implications for migration law. The first section discusses the position of the Istanbul Convention among similar international human right treaties and, in general, the regulation of violence against women and domestic violence in international law.
