[cze][eng] Práce pojednává o otázkách souvisejících s aplikací transplantačního zákona. Zaměřuje se na posouzení stávající právní úpravy transplantací, označení problematických oblastí transplantačního práva a možnosti jejich nápravy. Práce je rozdělena na několik částí. V úvodu se zabývá historií a vývojem transplantační medicíny, dále obsahuje popis stávající právní úpravy a stručný odkaz na mezinárodní úpravu. Těžiště práce je v rozboru nedostatků české právní úpravy a zdůraznění interdisciplinární povahy transplantačního práva. Na závěr je rozebrána změna transplantačního zákona chystaná ministerstvem zdravotnictví. Český transplantační zákon je právní úpravou moderní a respektující mezinárodní závazky. Charakter úpravy je dán jeho základními aspekty zásadou předpokládaného souhlasu ve spojení s právně garantovanou zárukou respektování relevantně vyjádřeného nesouhlasu, upřednostněním zemřelého dárce před žijícím, principem spravedlnosti při alokaci orgánů čekajícím pacientům, dodržováním zásady piety při nakládání s mrtvým tělem a zákazem finančního prospěchu. Mezi obtíže, s nimiž se české transplantační právo potýká, patří nevyváženost úpravy odběru orgánů zemřelým cizincům, velmi neuspokojivá míra informovanosti veřejnosti odborné i laické, vytvoření eticky konfliktní situace v případě odmítnutí...The Human Organ Transplantation Act - moral and ethical problems of its application This thesis deals with issues related to the applications of the Human Organ Transplantation Act. It is focused on the assessment of existing legislation regarding transplantation, the identification of problematical areas of transplantation law and the possibility of their correction. The thesis is divided into several parts. At the beginning it deals with the history and development of transplant medicine. It also contains a description of the current legislation and a brief summary of an international regulation. The main focus of the thesis is to analyze the deficiencies in Czech legislation and to emphasize the interdisciplinary nature of the transplant law. Finally, it analyzes the forthcoming amendment to The Human Organ Transplantation Act prepared by the Ministry of Health. The Human Organ Transplantation Act is a modern legislation respecting international commitments of the Czech Republic.
