Závěr Jedním z důležitých faktorů rozhodování investorů při alokaci kapitálu je otázka zdanění, neboť zejména přímé daně důchodového typu mají bezprostřední dopad na celkový výsledek podnikání, tedy úroveň dosaženého zisku. Tyto daně jsou stále jednou z domén suverénních států, které ani v rámci stále více se integrující Evropy nepodléhají unifikujícím tendencím a představují tak jistý prvek konkurence mezi státy, kterým je možno udržovat stávající investory a stimulovat nové investice. Na druhou stranu představují tyto daně v evropském prostoru významnou a tradiční položku příjmů státních rozpočtů. Například v roce 2007, kdy celkové příjmy státního rozpočtu ČR dosáhly výše 1.026 mld. Kč, bylo z titulu přímých daní dosaženo částky 196 mld. Kč, tedy 22 % celkových příjmů, přičemž hlavními položkami přímých daní byly právě daně důchodové, tzn. daně z příjmů fyzických a právnických osob, které zahrnují jak daně z příjmů obchodních společností, tak jejich účastníků, pokud dividendový příjem či podíl na zisku není zdaňován jinou daňovou jurisdikcí. Především v souvislosti se snahou udržet relativně vysoký sociální standard širokých vrstev obyvatel nelze reálně předpokládat jejich významné snížení. I do budoucna tak bude tato otázka vysoce aktuální a lze se domnívat, že bude přibývat podnikatelských... 87 Resumé This diploma thesis named "Taxation of income of companies and their participants (comparison of legal regulations in the selected EU states - the Czech Republic, Slovakia and Poland)". The thesis is divided into a theoretical and practical part. Chapters 1 - 6 form the theoretical part and chapters 7 - 9 form the practical part. The theoretical part contains a definition of tax, possible division of taxes, definition of a tax system and description of the structure of tax systems in the selected EU states, namely in the Czech Republic, Slovakia and Poland. Afterwards, I define the main legal sources relating to taxation of companies and its participants in the above mentioned states as well as relevant international treaties on avoidance of double taxation. This is followed by a brief theoretical description of basic concepts in the tax theory - tax object, tax base and tax maturity. Another chapter pays attention to the importance of international treaties on avoidance of double taxation and to explanation of the main principles of the methods on elimination of double taxation.
