[cze][eng] Předkládaná diplomová práce se zabývá tématem "Uznání a výkon cizích rozhodnutí v Evropské unii" (Mezinárodní civilní procesní právo v Evropské unii - vybrané otázky). Záměrem práce je poskytnout systematický přehled právních nástrojů, v jejichž režimu může uznání a výkon cizího rozhodnutí v praxi probíhat. Práce je řazena do osmi kapitol, kterým předchází úvod a následuje závěr. V úvodu práce je nastíněna hlavní snaha o přehlednou analýzu jednotlivých nařízení, která tuto problematiku regulují a dále jsou vysvětleny základní pojmy důležité pro zpracovávanou problematiku. Následující kapitoly se již zabývají příslušnými nařízeními a mají logicky jednotnou strukturu. V úvodu každé kapitoly je nastíněna základní charakteristika daného nařízení, jeho přijetí a základní cíle. Následuje vymezení věcné působnosti nařízení a poté již samotná úprava uznání a výkonu cizího rozhodnutí, následně je kapitola zakončena přehledem vztahu daného nařízení k ostatním právním nástrojům. Náplní druhé kapitoly je uznání a výkon cizích rozhodnutí podle nařízení Brusel I (Nařízení Rady (ES) č. 44/2001, o příslušnosti a uznávání a výkonu soudních rozhodnutí v občanských a obchodních věcech), které je v této oblasti prvním právním nástrojem a pro následně přijímaná nařízení určitým vzorem. Třetí kapitola zpracovává postup...This thesis deals with the topic " Recognition and enforcement of foreign judgements in the European Union (International civil procedure law in the European Union - selected issues). Aim of my thesis is to provide systematic overview of legal rules directly applicable on recognition and enforcement of foreign judgements. The text is divided into eight main chapters, introduction and conclusion. The introduction of the thesis describes purpose of the text that is to compare particular regulations governing these questions and also defines basic terminology important for this topic. Following chapters focus on relevant regulations and have uniform structure. Opening of each chapter explains elementary characteristics of applicable regulation, reception of this regulation and its main goal. Next subchapters contain demarcation of the material competence of regulation, after that follows procedure of recognition and enforcement of foreign judgements. The chapter ends with relations to other instruments. Chapter Two concentrates on the recognition and enforcement of foreign judgements pursuant to Brussels I Regulation (Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters) which is the first legal instrument in this area and...
