Závěr Právními instituty, které byly zkoumány v této práci, jsou zaměstnanecká díla, díla na objednávku a kolektivní díla. V současném autorském zákoně z roku 2000 jsou tyto právní instituty pojímány nově. Společnou jim je snaha chránit soukromé zájmy osoby, která do tvorby díla investuje netvůrčím způsobem. Za autora je stále považována fyzická osoba, která dílo vytvořila. Ji jsou také garantována nezcizitelná výlučná osobnostní a majetková práva k autorskému dílu. Avšak zákon dispozitivně zasahuje do těchto práv autora ve prospěch osoby investující do tvorby. Předpokladem těchto zákonných zásahů je právní vztah mezi autorem a osobou do tvorby investující, který je založený smlouvou. Tyto tři instituty jsou si poměrně blízké a jsou vzájemně provázané. V některých případech může být obtížné určit, pod který z těchto režimů dílo podřadit. Správné podřazení je v těchto případech ale velmi důležité. Do výlučných práv autora je zasahováno jak v případě zaměstnaneckého díla, díla na objednávku, tak i kolektivního díla, ale pokaždé v jiném rozsahu. Strany si mohou mezi sebou sjednat vlastní odlišnou úpravu svých práv a povinností k dílu, protože zákonná úprava těchto institutů je dispozitivní. Zákonná ustanovení se uplatní, jen není-li odlišného smluvního ujednání. Variant rozvržení práv k dílu tedy může být... A work produced by an employee, upon the order and a collective work Shrnutí / summary This thesis deals with juridical institutes of works produced by an employee, works upon order and collective works. Such institutes are characterized by entitling other person than author to rights to the author's work. These persons contribution to creation of the work rest on a noncreative investment into the development of original work - examples of such entities are employer or order party. Czech author's law belongs to civil law system of author's rights, which recognizes the natural person that created the work as the author. However, the protection of other person's private interests besides the authors' is strongly influenced by copyright system, which is characteristic for Anglo-American legal system. This thesis handles the Czech legal institutes in detail. Since the three institutes are interconnected they are dealt with the historical and comparative perspective. Furthermore, the approach of the Czech institutes is compared to analogous legal approaches of foreign countries. Employee's work is created by an employee within the scope of employment or similar relationship. The employee is the author of the work, and both moral and economic rights are vested in the author.
