[cze][eng] Cílem mé diplomové práce je popsat a zhodnotit současnou právní úpravu právních úkonů směřujících ke skončení pracovního poměru. Snažím se upozornit na nedostatky v současné právní úpravě a navrhnout jejich řešení. V prvé kapitole se zaměřuji na vývoj pracovního práva. Při popisu se snažím hledat historické souvislosti, které vytvářely a formovaly pracovního právo, jeho jednotlivé instituty a jeho vztah k právu občanskému. Druhá kapitola je věnována právním úkonům obecně a pracovnímu poměru. Vymezuje, co je to pracovněprávní úkon a jaké jsou jeho náležitosti, kdy nastává jeho neplatnost, následky neplatnosti a náležitosti pracovního poměru. Třetí kapitola je obecným úvodem k samotné problematice právních úkonů směřujících ke skončení pracovního poměru. V kapitole čtyři vymezuji zákonné náležitosti dohody a její využitelnost v současné době. Pátá kapitola se věnuje výpovědi a jejím náležitostem, zejména zákonným důvodům výpovědi a ochranné době. Kapitolu jsem rozdělil na dvě podkapitoly podle subjektu, který pracovní poměr jednostranně ukončuje. V první podkapitole se zabývám výpovědí ze strany zaměstnance a druhá podkapitola je věnovaná výpovědi ze strany zaměstnavatele, tu dále dělím na další dvě podkapitoly. V první popisuji institut ochranné doby a jeho vliv na výpověď zaměstnavatele a druhá...The aim of this thesis is to describe and evaluate the current legal system of legal acts aimed at termination of employment. I draw attention to shortcomings in the current legislation and propose solutions. The first chapter focuses on the development of labour law. In describing there are searched historical connections that created and formed the labour law, its various institutes and its relationship to civil law. The second chapter deals with the legal acts in general and the employment relationship. This part defines what a labour act is and what are its elements, which sets its non-validity, consequences of invalidity and particulars of employment. The third chapter is a general introduction to the very issue of legal actions aimed at termination of employment. In the fourth chapter there are defined the legal requirements of agreement and its applicability in the present time. The fifth chapter deals with the notice and its requirements, especially legal reasons and statements of the time. The chapter is divided into two parts according to the subject which determines employment unilaterally.
