1 Abstrakt Téma: Institut stálé provozovny v daňovém právu Autor: Marek Vaněk Vedoucí diplomové práce: JUDr. Petr Kotáb, Ph.D. Tato diplomová práce se zabývá institutem stálé provozovny zejména tak, jak je upraven ve Vzorové smlouvě OECD a v zákoně o daních z příjmů. První část práce je věnována jednotlivým kategoriím stálé provozovny (kamenná, stavebně-montážní, službová, agentská a společníků veřejné obchodní společnosti, komplementářů komanditní společnosti a společníků společnosti), a to zvlášť podle úpravy ve Vzorové smlouvě OECD a zvlášť dle české úpravy v zákoně o daních z příjmů, spolu s úpravou z obsaženou v dalších pramenech, zejména v pokynech MFČR a GFŘ. Práce obsahuje podrobnou analýzu předpokladů pro vznik stálé provozovny, včetně příkladů. Dále je pojednáno o určování daňové rezidence u fyzických i právnických osob, která je významným faktorem pro aplikaci bilaterálních smluv o zamezení dvojího zdanění (zejména pro podmínky vzniku stálé provozovny), včetně problematiky prokazování daňové rezidence u daňově transparentních entit. Stálá provozovna má dopad i na daň z přidané hodnoty. V této části práce jsou popsány do oblasti daně z přidané hodnoty, zejména u tzv. kvaziobchodů, tj. transakcí mezi zřizovatelem a jeho organizační složkou. Zmíněna je i problematika určování místa plnění při dodání... 1 Abstract Title: The concept of the permanent establishment in the tax law Author: Marek Vaněk Supervisor: JUDr. Petr Kotáb, Ph.D. This thesis analyses the law concept of the permanent establishment, mainly the legislation contained in the OECD Model Tax Convention and in the Income Tax Act. The first part of the thesis analyses the types of permanent establishment (fixed, building and construction sites, service-based, agent-based and permanent establishment of the shareholders of partnerships and limited partnerships), separately according the OECD Model Tax Convention and according to the Income Tax Act. The thesis also analyses subsequent sources of law. The thesis includes a detailed analysis of conditions which are necessary for the existence of the permanent establishment, inclusive examples, including information of the Ministry of finance and the General Financial Directorate that have impact on the permanent establishment treatment. Furthermore, the thesis deals with the determination of the tax residency of persons and legal bodies which is a significant factor for the application of bilateral double taxation treaties (mainly with the circumstances of the existence of the permanent establishment), including the issues connected with proving of the tax residency of the tax transparent entities....
