v českém jazyce V rámci reformy veřejné správy, jejímž cílem je zefektivnění fungování orgánů veřejné správy, byl přijat, inter alia, zákon č. 183/2006 Sb., o územním plánování a stavebním řádu (stavební zákon) (dále jen "stavební zákon") nahrazující předchozí právní úpravu na úseku územního plánování a stavebního řádu.1 Stavební zákon tedy zavedl s účinností od 1.1.2007 na úseku stavebního řádu nové instituty - pro účely této práce se zaměříme na institut veřejnoprávní smlouvy o provedení stavby a institut zkráceného stavebního řízení jako alternativy povolovacího režimu provádění staveb. Zavedením institutu veřejnoprávní smlouvy o provedení stavby a institutu zkráceného stavebního řízení bylo sledováno zejména ulehčení práce přetíženým stavebním úřadům a současně též urychlení a zjednodušení procesů povolování staveb. Také se jedná o reakci na zákon č. 500/2004 Sb., správní řád (dále jen "správní řád") a zde zakotvený princip subsidiarity vyjadřující, že vydání jednostranného vrchnostenského rozhodnutí (v tomto případě "stavebního povolení") je v podstatě chápáno jako poslední možnost, přičemž je preferováno přímé zapojení zainteresovaných subjektů. Cílem předkládané práce je analyzovat aktuální právní úpravu institutu veřejnoprávní smlouvy o provedení stavby a institutu zkráceného stavebního... The purpose of my thesis is to analyze the legal regulation of the public law contract on realization of the structure, which can be concluded under the Section 116 of the Building Act with the approval of the respective authorities between the building office and the developer and the summary building permit proceedings under the Section 117 of the Building Act, which consists in a concluded contract on making a check of the design documentation for the structure between the developer and an authorized inspector. The main aim of the reform of public administration is among others to democratize and more privatize the building permit proceeding and create the alternatives to the classical building permit proceeding. These alternatives are above mentioned the public law contract on realization of the structure and the summary building permit proceedings. The both institutes are capable to replace the building permit. The other purpose of my thesis is to point out shortcomings in the current legislation in connection with the proposed amendment to the Building Act. The thesis is composed of two extensive chapters, each of them dealing with different alternatives to the classical building proceeding.
