Svěřenský fond je v českém právu zcela nový institut, proto je jeho hlubší právní zkoumání a interpretace jednotlivých ustanovení teprve v počátcích. Upraven je obecně v zákoně č. 89/2012 Sb., občanský zákoník, v platném znění. Podstata svěřenského fondu spočívá v tom, že zakladatel vyčlení ze svého majetku jeho určitou část a tu svěří k nějakému účelu. Tím vznikne oddělené vlastnictví, k němuž již původní vlastník (zakladatel) nemá žádná vlastnická práva. Správu takto vyčleněného majetku vykonává svěřenský správce, na kterého však vlastnictví převedeno není. Majetek ve svěřenském fondu tedy nepatří nikomu, svěřenský správce s ním však může nakládat. Cílem této diplomové práce je komplexně shrnout a analyzovat zdanění svěřenských fondů jak podle zákonů platných v roce 2014, tak po jejich úpravě od ledna 2015. V práci jsou identifikovány problémy a nejasnosti při zdanění fondů. Vysvětluje, jak byly tyto problémy odstraněny v rámci novelizace daňových zákonů, a v případě přetrvávajících nejasností navrhuje jejich řešení de lege ferenda. Práce je rozdělena do dvou hlavních částí. V první části se věnuji obecně institutu svěřenského fondu. Je zde vysvětlena jeho podstata, fungování a obligatorní náležitosti. V druhé, hlavní části této diplomové práce, se pak detailně zaměřuji na daňové aspekty svěřenského... The Trust Fund is for the Czech law a completely new institution, therefore its deeper legal examination and interpretation of its individual provisions is just at the beginning. It is generally regulated by the Act no. 89/2012 Sb., the Civil Code, as amended. The essence of the Trust Fund lies in the fact that the Settlor separates a specified part of his property and entrusts it to some purpose. This creates a separated property, to which has the original owner (the Settlor) no ownership rights. Management of this separated property performs the Trustee. However, he has no ownership of this property. Property in the Trust Fund does not belong to anyone, but the Trustee can dispose of it. The aim of this thesis is to comprehensively summarize and analyze the taxation of the Trust Fund according to the regulation applicable in 2014 and also after its revision in January 2015. The thesis identifies the problems and uncertainties in taxation of Trust Fund. It explains how these problems were solved by the revision of the Tax Law and in case of persisting uncertainties proposes solutions de lege ferenda. The thesis is divided into two main parts.
