Převody vlastnictví bytů z bytového družstva na jejich členy Cílem této diplomové práce je rozbor právní úpravy převodů vlastnictví bytů z bytového družstva na jejich členy. Jedná se o aktuální téma, jelikož v dnešní době je stále mnoho členů, kteří nemají dosud vypořádané právní nároky vůči bytovému družstvu. Pozornost je v práci věnována především právní úpravě obsažené v zákoně o vlastnictví bytů. Vedle toho je zmíněna i úprava transformačního zákona, která zavádí právní úpravu převodů družstevních bytů do vlastnictví členů. Dále jsou podrobena analýze jednotlivá ustanovení obchodního zákoníku, která souvisí s právní úpravou bytových družstev. Diplomová práce se skládá ze čtyř kapitol. První kapitola pojednává o vzniku a vývoji bytového družstevnictví, vysvětluje jeho základní principy a zejména charakterizuje koncepce vzniku tehdejších stavebních bytových družstev a lidových bytových družstev. V této úvodní kapitole jsou rovněž vymezeny základní pojmy bytového družstevnictví, jako je bytové družstvo a družstevní byt. Druhá kapitola je výkladem platné právní úpravy převodů vlastnictví družstevních jednotek. Předně je podrobně analyzována zákonná ochrana člena bytového družstva. Značná pozornost je věnována kontraktační povinnosti bytových družstev, kde jsou podrobněji popsány zvláštní zákonné... 1 Abstract Transfer of ownership of flats from the cooperatives to its members The aim of this thesis is to analyze the legislative regulation of transfers of ownership of flats from housing cooperatives to their members. This is a hot topic, since there are still many members who have not yet settled legal claims against the housing cooperatives. Attention is paid to the legislation contained in the Act on ownership of flats. In addition, legal regulation in the Transformation Act is mentioned, which introduced legislation on transfer of ownership from housing cooperative to its members. Individual provisions of the Commercial Code, which relates to housing cooperatives legislation, are also being analyzed. The thesis consists of four chapters. The first chapter discusses the formation and development of housing cooperatives, explains its basic principles and mainly characterizes concepts of former housing cooperatives. This introductory chapter also defines the basic terms of the housing cooperatives, such as a cooperative housing and cooperative apartment. The second chapter is interpretation of the contemporary legislation on transfer of ownership of cooperative units.
