[cze][eng] RÉSUMÉ Tato diplomová práce se zabývá institutem "Vyvlastnění nemovitostí", tedy vážným zásahem do jinak nedotknutelného absolutního práva vlastnit majetek, které je garantováno jak Ústavou České republiky, tak i evropskou Úmluvou o ochraně lidských práv a základních svobod. Práce se zaměřuje na základní principy institutu "Vyvlastnění", na současnou právní úpravu, porovnání úpravy s úpravami předchozími, srovnává současnou úpravu s úpravami v jiných, vybraných zemích Evropské unie, zabývá se současnou i minulou soudní praxí, rozebírá soudní judikáty soudů všech stupňů, které se zabývají tématikou "Vyvlastnění". Práce rovněž komentuje současnou právní úpravu, nastiňuje potencionální problémy a snaží se přinášet jejich řešení v duchu toho, že k současné právní úpravě téměř neexistuje odborná literatura a v celé novodobé historii České republiky nebyl tento institut ani bohatě judikován, což na druhou stranu ponechává mnoho prostoru k úvahám každého autora, který se danou problematikou zabývá. Na druhou stranu je jistě obtížné tuto tématiku, vzhledem k nedostatku shora zmíněných pramenů, uchopit a řádně se jí zhostit. Široce ponechaný prostor skýtá možnost různorodé interpretace a odlišných názorů a tím pádem i těžkosti určit, co je objektivně správné a co je pouze subjektivním názorem autorovým, se kterým...RÉSUMÉ This master's thesis examines the legal institute of "Expropriation of Real Property", i.e. severe interference with the inalienable absolute right to own property, which is guaranteed by the Constitution of the Czech Republic as well as the European Convention for the Protection of Human Rights and Fundamental Freedoms. This thesis concentrates on the basic principles of the institute of "Expropriation", the current legal framework, its comparison to earlier institutes and to the institutes implemented in various EU member states; it also examines current and past court cases and analyses court rulings of all levels of jurisdiction dealing with the subject of "Expropriation". This thesis also comments on the current legal framework, indicates its potential problems and attempts to find a solution taking into account that there is hardly any literature covering the current legal framework and that there have not been many court rulings dealing with this subject in contemporary Czech history, which on the other hand gives enough space for the reasoning of the respective authors covering the given subject.
