[cze][eng] Závěr Charakteristickými znaky nynějšího společenství vlastníků jednotek jsou tyto skutečnosti: 1. SVJ i členství v něm vzniká nezávisle na vůli jednotlivých vlastníků. 2. SVJ má omezenou způsobilost k právům a povinnostem i způsobilost k právním úkonům. 3. SVJ vzniká za účelem správy společných částí domu. 4. Předmět činnosti i rozsah právních úkonů SVJ je vymezen zákonem. Společenství dle návrhu nového zákona o vlastnictví bytů by vznikalo v souladu s projevenou vůlí původního vlastníka budovy, a to zápisem do rejstříku společenství. Společenství by tak existovalo již před převodem vlastnictví k první jednotce. Členství v něm by pak nadále vznikalo automaticky s nabytím vlastnictví jednotky. Rovněž tak by společenství nadále vznikalo za účelem správy společných částí domu a jeho kompetence by byly zákonem omezené. Zatímco doposud problematiku společenství vlastníků jednotek řeší čtyři paragrafy BytZ a vzorové stanovy, jež jsou přílohou k nařízení vlády, navrhovaný zákon věnuje společenství podstatně více prostoru. Nejnovější návrh zákona o vlastnictví bytů se snaží o zohlednění všech připomínek, které byly vzneseny nejen na adresu zákona stávajícího, ale i na adresu předchozích návrhů nového zákona o vlastnictví bytů. The purpose of my thesis was to define specialties of this legal person and describe its existence in wider connections. In my thesis I lay special stress on problems resulting from exact wording of legislation. Whole thesis is divided into nine parts. Short introduction is followed by seven capitols, after which the conclusion follows. Each capitol thinks of existing problems from different point of view. First chapter deals with the theoretic delimitation of pivotal terms, namely the term legal person, corporate body and Association of owners of units. Second chapter considers the historical view; it describes the development of legal regulations of the Association of owners of units. Individual subchapters mention the most important statutory rules solving these problems. Third chapter describes valid legal regulations of the Association of owners of units. It is divided into five subchapters, which attend to the creation and end of the Association of owners of units, object of the activity of this legal person, membership in Association of owners of units, its authorities and Articles of Association.
