JUDr. Pavel Šturma, DrSc. Abstrakt: Práce je především zaměřena na výklad článku 2 Úmluvy, který garantuje jedno ze základních lidských práv, a to právo na život. V první části práce se zabývám samotnou Evropskou úmluvou o ochraně lidských práv a základních svobod, zejména její aplikací, aby bylo patrné, kdy může dojít k porušení Úmluvy. Dále věnuji pozornost fungování Evropského soudu pro lidská práva, který byl zřízen za účelem kontroly dodržování jednotlivých práv a svobod garantovaných Úmluvou a jejími dodatkovými protokoly, které se státy přistoupením k Úmluvě zavázaly dodržovat. Poté se zabývám již samotným výkladem článku 2 Úmluvy a snažím se za pomoci bohaté judikatury Soudu popsat, jaké povinnosti smluvním státům vyplývají z článku 2 Úmluvy a jaké musí dodržovat, aby postupovaly v souladu s Úmluvou, kterou se zavázaly dodržovat. Státům vznikají hmotněprávní i procesněprávní povinnosti, které lze dále dělit na pozitivní a negativní. Tyto povinnosti postupně uvádím spolu s konkrétními případy, ve kterých Soud řešil danou problematiku. V práci nechybí ani zmínka o tématech jako je eutanazie, trest smrti... JUDr. Pavel Šturma, DrSc. Abstract: The thesis is mainly focused on the interpretation of the article 2 of the Convention which guarantees one of the most important human rights, the right to life. In the first part of the thesis I deal with the European Convention on Human Rights, especially its aplication to be clear when the violation of the Convention is possible. Then I concentrate on the functioning of European Court of Human Rights which was constituted for the purpose to execute the control of compliance with rights and liberties guaranteed by the Convention and Additional Protocols to the Convention which contracting states obligate to fulfill. Then I handle the interpretation of the article 2 of the Convention and I try to describe with the help of judicature of the Court which obligations must be fulfilled by the contracting states and how the contracting states must behave to comply with the Convention.
