Cílem práce je přehledně popsat všechny platební služby, které lze nalézt ve stávajícím zákoně o platebním styku z roku 2009, ale i nové platební služby, které přináší nový zákon o platebním styku. Nový zákon o platebním styku nabyde účinnosti dne 13. ledna 2018. Důvodem pro jeho přijetí byla nutnost transpozice revidované směrnice o platebních službách známé jako PSD II. Tato směrnice vnáší do oblasti regulace platebního styku mnoho změn. Dále se práce věnuje představení a analýze všech subjektů, které mohou v České republice poskytovat platební služby. V první části práce je stručně popsán vývoj regulace platebního styku v České republice. Vzhledem k obsáhlosti tohoto tématu je jen nastíněno, jaké zákony platební styk v České republice doposud upravovaly. Druhá část práce se zaměřuje na pozitivní a negativní vymezení platebních služeb. Při popisu jednotlivých platebních služeb jsou zmíněny problematické situace, které mohou v souvislosti s danou platební službou nastat. Část věnovaná negativnímu vymezení platebních služeb pojednává o výjimkách, díky kterým nejsou dle stávajícího i nového zákona o platebním styku některé činnosti platebními službami. Určení, zda daná činnost spadá pod výjimku a není platební službou, je pro jejího poskytovatele zásadní. Třetí část práce přináší přehled a analýzu... The aim of this thesis is to clearly describe all payment services which can be found in current Act on Payments of 2009 and also new payment services under new Act on Payments. New Act on Payments will come into effect on 13 January 2018. The reason for its adoption was the need of transposition of the revised Payment Services Directive known as PSD II. This directive brings significant number of changes into the area of the regulation of payments. Moreover, this thesis devotes to introduction and analysis of all subject authorized to provide payment services in the Czech Republic. The development of the regulation of payments in the Czech Republic is briefly described in the first part of the thesis. Regarding the extensiveness of this topic, it is only outlined which acts have regulated payments in the Czech Republic. The second part of the thesis deals with positive and negative definition of payment services. When describing a single payment service, the difficult situations which can occur due to this payment service are mentioned. The section on negative definition of payment services explains the exceptions which cause that some activities are not consider to payment services pursuant to current and new Act on Payments.
