Kapitoly předkládané diplomové práce "Souhlas k jurisdikci MSD ve sporném řízení se zaměřením na tzv. automatické výhrady" se dají pomyslně rozdělit na obecnou a speciální část. Obecná část představuje a vymezuje jednotlivé způsoby, kterými stát ve sporném řízení může vyslovit souhlas k jurisdikci MSD. V této části práce jsou vysvětleny výhody a zrovna tak i nevýhody jednotlivých způsobů, s hlavním zaměřením na opční prohlášení, neboť ta jsou základem pro následující, specifickou, část práce. Zde je pro účely definice opčních prohlášení podroben analýze článek 36 odstavec 2 Statutu MSD, právní základ opčních prohlášení. Ze všech specifik a charakteristik tohoto způsobu založení jurisdikce MSD je věnována další pozornost výhradám, kterými státy mohou svá prohlášení podmínit. Práce detailněji rozebírá odstavec 3 článku 36 Statutu MSD, představuje nejčastěji užívané výhrady a analyzuje judikaturu MSD dotýkající se tohoto tématu. Tato materie je obsažena v prvních třech kapitolách a slouží jako kontext pro další část práce, která se věnuje pouze automatickým výhradám jakožto nejkontroverznějšímu druhu výhrad k opčním prohlášením. Zde práce nejprve automatické výhrady definuje, poté uvádí jejich nejčastější podoby, jejich znění, a zmiňuje i současný trend jejich užívání. Stěžejní část práce se zabývá... The chapters of the presented diploma thesis "Consent to the jurisdiction of the ICJ in contentious proceedings with a focus on the so-called automatic reservations" factually divide into a general and a special part. The general part introduces and defines all ways by which a state in contentious proceedings may consent to the jurisdiction of the ICJ. This part of the thesis explains the advantages as well as the disadvantages of each of these means, with the main focus on the optional clause declarations, as these constitute the basis for the following, specific, part of the thesis. Article 36(2) of the ICJ Statute, the legal basis for optional clause declarations, is analysed in this part for the purpose of defining the features of the optional clause declarations. Of all the specifics and characteristics of this way of establishing the jurisdiction of the ICJ, further attention is given to the reservations that states may condition their declarations with. The thesis not only analyses in detail Article 36, paragraph 3, of the ICJ Statute, but it also presents the most frequently used reservations and it examines the ICJ jurisprudence on the subject.
