Diplomová práce se zabývá problematikou lidských práv právnických osob dle EÚLP. Právnické osoby jsou vedle osob fyzických nositeli základních práva a svobod. Tato práva dosahují takového významu, že jsou hodna ochrany, a to nejen na úrovni vnitrostátní, ale i na úrovni regionální a univerzální. Pro 47 evropských zemí je ochrana základních práv a svobod zajišťována mezinárodní organizací zvanou Rada Evropy. V rámci Rady Evropy působí Evropský soud pro lidská práva zřízený na základě Úmluvy o ochraně lidských práv a základních svobod z roku 1950. Na tento soud se se svými stížnostmi obrací fyzické osoby a tam, kde to povaha základních práv a svobod uvedených v Úmluvě a jejích protokolech připouští, též osoby právnické. Za pomoci deskriptivní, komparativní a analytické metody si tato diplomová práce dává za cíl uceleně představit právnickou osobu v roli individuálního stěžovatele před ESLP, přičemž zvláštní pozornost věnuje judikatuře ESLP, konkrétně rozsudkům o stížnostech právnických osob proti České republice, kterých je k dnešnímu dni 27. Práce je rozdělena do tří částí. První část se zabývá pojmem právnické osoby jako takové, přičemž dále popisuje její roli individuálního stěžovatele před ESLP, a to ve světle čl. 34 EÚLP. Tato část se dále zabývá podmínkami přijatelnosti stížností právnických... The diploma thesis deals with the issue of human rights of legal persons according to the ECHR. In addition to natural persons, legal persons are holders of fundamental rights and freedoms. These rights are so important that they are worthy of protection, not only at national level, but also at regional and universal level. For 47 European countries, the protection of fundamental rights and freedoms is ensured by an international organization called the Council of Europe. Within the Council of Europe, there is a European Court of Human Rights established under the Convention for the Protection of Human Rights and Fundamental Freedoms of 1950. Natural persons and, where the nature of the fundamental rights and freedoms set out in the Convention and its protocols allow, also legal persons lodge complaints with this court. Using a descriptive, comparative, and analytical method, this thesis aims to comprehensively present the legal person in the role of an individual applicant to the ECtHR, paying special attention to the case-law of the ECtHR, specifically judgments on legal persons' applications against the Czech Republic.
