Reorganizace dle insolvenčního práva Abstrakt Předkládaná diplomová práce se z širokého tematického okruhu, kterým reorganizace bezesporu je, snaží vyčlenit oblasti, kterým je následně věnován širší prostor při snaze o jejich alespoň částečně detailnější rozbor. Mezi tyto oblasti patří zejména problematika zkoumání vhodnosti využití institutu reorganizace jakožto zásadně sanačního způsobu řešení úpadku pro různé, typově charakterizované situace. Pozornost je přitom věnována jak ekonomickým, tak i právním předpokladům realizovatelnosti reorganizace, a to se zvýšeným důrazem na zkoumání motivace osob, které mohou prosazení a následnou realizaci reorganizace významně ovlivnit. S uvedenou problematikou úzce souvisí i samotný proces určení vhodného způsobu řešení úpadku, o kterém je v práci rovněž podrobněji pojednáno, přičemž zvýšená pozornost je věnována především posouzení dostatečné informovanosti věřitelů dlužníka. Rozebrána je také problematičnost platné zákonné úpravy sestavování znaleckého posudku, který by mohl právě k větší informovanosti věřitelů významným způsobem přispět. V této souvislosti jsou zmíněny i některé návrhy zákonné úpravy, mající za cíl zlepšit využitelnost znaleckého posudku v reorganizaci. V rámci celé práce je pak kladen důraz na aktuálnost probíraných témat, a to nejen s ohledem na... Reorganization under insolvency law Abstract Diploma thesis from quite vague scope, as reorganization apparently is, focused on specific areas in insolvency proceedings and trying to bring a more concrete point of view and a more detailed perspective. Those areas include problems of suitability research that can be use by reorganization institute, as fundamental remediation for solving bankruptcy for various situations. Focus is on both economics, also a legal assumption of the feasibility of reorganization, yet to increase an emphasis on examining the motivation of people, who apparently can affect the enforcement and can significantly affect the implementation of reorganization. Determination process of appropriate way to resolve the insolvency situation is closely related to its solution and is also more detail explained in thesis. As a main key is considered to have enough and sufficient information about debtor's creditors. Valid legal problems and regulations of compiling a professional assessment, which might lead to better knowledge for creditors. In this context, some legislative proposals aimed at improving the usability of assessment in the reorganization are also mentioned. Within the whole work, emphasis is placed on the topics discussed, not only with regard to the recent legislative changes....
