1 Abstrakt disertační práce k tématu "Omezení vlastnického práva z důvodů ochrany životního prostředí ve srovnávacím pohledu" Vlastnické právo a z něho vyplývající oprávnění užívat a používat vlastnictví je zakotveno mezi základními lidskými právy a třetí osoby musí toto právo plně respektovat. Nicméně vlastnické právo jednotlivce je omezené již z povahy věci. Jednak z toho důvodu, aby bylo zaručeno vlastnické právo, resp. jiná základní práva a svobody jiných právních subjektů Jednak proto, aby bylo zabezpečeno prosazení veřejných zájmů. Jedním z důležitých veřejných zájmů, které vyžadují omezení vlastnického práva, je ochrana životního prostředí. Základním tématem předkládané práce je právě omezení vlastnického práva z důvodů ochrany životního prostředí, a to ve srovnávacím pohledu švýcarského práva a práva České republiky. S ohledem na absolutorium právní vědy na právnické fakultě univerzity v Curychu ve Švýcarsku adresuje autor v disertační práci především právníkům a dalším zainteresovaným osobám z České republiky. Pro vysvětlení právních vztahů na úseku omezení vlastnického práva z důvodů ochrany životního prostředí zvolil jako základ švýcarskou právní úpravu s uvedením relevantních ustanovení, jakož i aktuální nauky a judikatury.
