Obě tyto změny jsou obtížně uchopitelné stávajícím teoretickým aparátem, který vychází z (i) Rousseauova konceptu volonté générale, který zajišťuje svrchovanost zákonodárné moci v ústavním systému; (ii) Montesquieovy teorie tří oddělených mocí (zákonodárné, výkonné a soudní), která jednak není schopna uchopit nové fenomény jako byrokracie či nezávislé agentury a jednak nepočítá s dělbou...
